9	9	AN ACT to renumber and amend 340.01 (22e); and to create 340.01 (22e) (a)
10	10	3. and 340.01 (22e) (b) of the statutes; relating to: penalties for certain traffic
11	11	violations where highway maintenance workers are present and providing a
12	12	penalty.
13	13	Analysis by the Legislative Reference Bureau
14	14	Under current law, the amount of any applicable minimum and maximum fine
15	15	or forfeiture is doubled for specified traffic violations committed where persons
16	16	working in a highway maintenance or construction area are at risk from traffic.
17	17	These traffic violations include failing to follow certain traffic signs and signals,
18	18	failing to follow certain orders of traffic officers, exceeding certain maximum speed
19	19	limits, and driving recklessly. Currently, “highway maintenance or construction
20	20	area" is defined as the section of highway between the first highway maintenance or
21	21	construction warning sign and either 1) a sign indicating the end of the maintenance
22	22	or construction work; or 2) in the case of a moving vehicle engaged in the
23	23	maintenance or construction work, the section of roadway where traffic may return
24	24	to normal flow without impeding the maintenance or construction work.
25	25	Under this bill, “highway maintenance or construction area” is defined to
26	26	include the roadway adjacent to which roadside cleanup or maintenance work is
27	27	being performed. In the case of highway cleanup work or roadside cleanup or
28	28	maintenance work, including the collection of litter, the highway construction or

35	35	maintenance area extends from the first advance warning sign to the furthest
36	36	location at which cleanup or maintenance workers are working.
37	37	The people of the state of Wisconsin, represented in senate and assembly, do
38	38	enact as follows:
39	39	SECTION 1. 340.01 (22e) of the statutes is renumbered 340.01 (22e) (a) (intro.)
40	40	and amended to read:
41	41	340.01 (22e) (a) (intro.) “Highway maintenance or construction area" means
42	42	the entire section of roadway between the first advance warning sign of highway
43	43	maintenance or construction work and an any of the following:
44	44	1. An “END ROAD WORK" or “END CONSTRUCTION" sign or , in.
45	45	2. In the case of a moving vehicle engaged in the maintenance or construction
46	46	work, that section of roadway where traffic may return to its normal flow without
47	47	impeding such the work.
48	48	SECTION 2. 340.01 (22e) (a) 3. of the statutes is created to read:
49	49	340.01 (22e) (a) 3. In the case of highway cleanup work or roadside cleanup or
50	50	maintenance work, including the collection of litter, the furthest location at which
51	51	cleanup or maintenance workers are working.
52	52	SECTION 3. 340.01 (22e) (b) of the statutes is created to read:
53	53	340.01 (22e) (b) “Highway maintenance or construction area" includes the
54	54	roadway adjacent to which roadside cleanup or maintenance work, including the
55	55	collection of litter, is being performed, regardless of whether the work is being
56	56	performed by paid workers or volunteer workers.
