1313 AN ACT to create 50.373 of the statutes; relating to: pelvic exams on
1414 unconscious patients and creating an administrative rule related to hospital
1515 requirements for pelvic exams on unconscious patients.

1717 This bill requires hospitals to ensure written informed consent is obtained
1818 from a patient before a pelvic exam is performed solely for educational purposes on
1919 the patient while the patient is under general anesthesia or otherwise unconscious.
2020 The bill also creates a Department of Health Services rule providing that hospitals
2121 must maintain written policies and procedures requiring written informed consent
2222 to be obtained from a patient before a pelvic exam is performed solely for
2323 educational purposes on the patient while the patient is under general anesthesia
2424 or otherwise unconscious.
2525 The people of the state of Wisconsin, represented in senate and assembly, do
2626 enact as follows:
2727 SECTION 1. 50.373 of the statutes is created to read:
2828 50.373 Informed consent for pelvic examinations. A hospital shall 2025 - 2026 Legislature

3333 ensure that, before a pelvic examination is performed solely for educational
3434 purposes on a patient while the patient is under general anesthesia or otherwise
3535 unconscious, written informed consent is obtained from the patient.
3636 SECTION 2. DHS 124.10 of the administrative code is created to read:
3737 DHS 124.10 Consent policy for pelvic examinations performed for
3838 educational purposes. A hospital shall maintain written policies and procedures
3939 requiring written informed consent to be obtained from a patient before a pelvic
4040 examination is performed solely for educational purposes on the patient while the
4141 patient is under general anesthesia or otherwise unconscious.
4242 SECTION 3. Effective dates. This act takes effect on the day after
4343 publication, except as follows:
4444 (1) The creation of s. DHS 124.10, Wis. Adm. Code, takes effect as provided in
4545 s. 227.265.
