Newborn safety device funding for safe haven providers.

A BILL
for
1 AN ACT relating to safety for a newborn child; authorizing 
2 a grant program for safe haven providers to purchase 
3 newborn safety devices as specified; providing definitions; 
4 requiring rulemaking; providing an appropriation; and 
5 providing for effective dates.

11 (a)  As used in this act:

14 (i)  "Newborn child" means as defined in W.S. 
15 14-11-102(a)(vi); 2025STATE OF WYOMING25LSO-05072HB00781
2 (ii)  "Newborn safety device" means a device 
3 installed at a safe haven provider where a newborn child 
4 can be safely placed and that alerts the personnel of the 
5 safe haven provider that a newborn child has been placed in 
6 the device;

8 (iii)  "Safe haven provider" means as defined in 
9 W.S. 14-11-102(a)(vii).

11 (b)  The department of family services shall establish 
12 and administer a grant program for the purpose of providing 
13 grants for safe haven providers to purchase newborn safety 
14 devices. The safe haven providers that receive grants under 
15 this act shall manage the newborn safety devices. Each safe 
16 haven provider shall receive not more than one (1) grant 
17 and one (1) newborn safety device.

19 (c)  The department of family services shall develop 
20 an application process for safe haven providers to apply 
21 for and receive grants to purchase newborn safety devices 
22 and shall review applications to determine eligibility. Any 
23 safe haven provider may apply for a grant under this  2025STATE OF WYOMING25LSO-05073HB0078
1 section pursuant to the application process established by 
2 the department of family services.

4 (d)  The temporary grant program shall terminate June 
5 30, 2026. Applications shall be received not later than 
6 March 1, 2026. No grants shall be awarded under this 
7 section after June 30, 2026.

9 There is appropriated three hundred 
10 thousand dollars ($300,000.00) from the general fund to the 
11 department of family services for purposes of implementing 
12 this act. This appropriation shall be for the period 
13 beginning July 1, 2025 and ending June 30, 2026. This 
14 appropriation shall only be used to make grants to safe 
15 haven providers to purchase newborn safety devices, except 
16 that not more than one percent (1%) of this appropriation 
17 may be used for administrative expenses incurred pursuant 
18 to this act. This appropriation shall not be transferred or 
19 expended for any other purpose and any unexpended, 
20 unobligated funds remaining from this appropriation on June 
21 30, 2026 shall revert as provided by law.

2 promulgate all rules necessary to implement this act.

6 (a)  Except as otherwise provided by subsection (b) of 
7 this section, this act is effective July 1, 2025.
8
9 (b)  Sections 3 and 4 of this act are effective 
10 immediately upon completion of all acts necessary for a 
11 bill to become law as provided by Article 4, Section 8 of 
12 the Wyoming Constitution.
