1313 1 AN ACT relating to public health and safety; requiring

3030 5 (a) As used in this chapter:

3232 7 (i) "COVID-19" means as defined in W.S.
3333 8 1-1-141(a)(ii);

3535 10 (ii) "Messenger ribonucleic acid vaccine" means
3636 11 a type of vaccine that uses called messenger ribonucleic
3737 12 acid to produce an immune response against a disease.

3939 14 (b) Any person who collects human blood donations for
4040 15 the purpose of providing blood for human blood transfusion
4141 16 shall require blood donors to disclose whether the blood
4242 17 donor has received a COVID-19 vaccine or a messenger
4343 18 ribonucleic acid vaccine at any time.

4545 20 (c) Blood originating from a donor who has received a
4646 21 COVID-19 vaccine or a messenger ribonucleic acid vaccine
4747 22 shall be conspicuously marked on the packaging of the blood

4949 2 (d) In a nonemergency situation, as determined by the
5050 3 health care provider providing medical services, a person
5151 4 receiving a blood transfusion shall have the right to
5252 5 request blood based on whether or not the blood originated
5353 6 from a person who has received a COVID-19 vaccine or a
5454 7 messenger ribonucleic acid vaccine, if the requested blood
5555 8 is available at the facility.

5757 10. The department of health shall promulgate
5858 11 all rules necessary to implement this act.
