A BILL
for
1 AN ACT relating to public health and safety; requiring 
2 blood donors to disclose vaccination status as specified; 
3 requiring blood packaging to be marked as specified; 
4 allowing a person who receives a blood transfusion to 
5 request the use of certain blood; providing definitions; 
6 requiring rulemaking; and providing for an effective date.

5 (a)  As used in this chapter:

7 (i)  "COVID-19" means as defined in W.S. 
8 1-1-141(a)(ii);
9
10 (ii)  "Messenger ribonucleic acid vaccine" means 
11 a type of vaccine that uses called messenger ribonucleic 
12 acid to produce an immune response against a disease.

14 (b)  Any person who collects human blood donations for 
15 the purpose of providing blood for human blood transfusion 
16 shall require blood donors to disclose whether the blood 
17 donor has received a COVID-19 vaccine or a messenger 
18 ribonucleic acid vaccine at any time.

20 (c)  Blood originating from a donor who has received a 
21 COVID-19 vaccine or a messenger ribonucleic acid vaccine 
22 shall be conspicuously marked on the packaging of the blood

2 (d)  In a nonemergency situation, as determined by the 
3 health care provider providing medical services, a person 
4 receiving a blood transfusion shall have the right to 
5 request blood based on whether or not the blood originated 
6 from a person who has received a COVID-19 vaccine or a 
7 messenger ribonucleic acid vaccine, if the requested blood 
8 is available at the facility.

10.  The department of health shall promulgate 
11 all rules necessary to implement this act.

13.  This act is effective July 1, 2025
