2727 2 services with a person who:

2929 4 (i) Is or becomes unlawfully present in the
3030 5 United States in violation of federal law; or

3232 7 (ii) Is not or becomes not lawfully authorized
3333 8 to work in the United States in violation of federal law.

3535 10 (b) A person who violates subsection (a) of this
3636 11 section is guilty of a misdemeanor punishable by a fine of:

3838 13 (i) One thousand dollars ($1,000.00) for a first
3939 14 offense under this section;

4141 16 (ii) Five thousand dollars ($5,000.00) for a
4242 17 second or subsequent offense under this section.

4444 19 (c) For purposes of this section:

4646 21 (i) The prohibition of subsection (a) of this
4747 22 section shall not apply to any employed or contracted

4949 1 authorization to be present and work in the United States

5252 4 (ii) Any employer who employs or contracts for
5353 5 services with workers who are or were lawfully present but
5454 6 who are acting in accordance with federal law to renew or
5555 7 continue their lawful status shall not be subject to the
5656 8 prohibition in subsection (a) of this section;

5858 10 (iii) Each person who is employed, contracted
5959 11 with or continued to be employed in violation under
6060 12 subsection (a) of this section shall constitute a separate
6161 13 offense.
