25	25	2 association" means any incorporated or unincorporated
26	26	3 association that is owned by or whose members consist
27	27	4 primarily of the owners of property governed by an
28	28	5 enforceable legal document through which the owners, or the
29	29	6 board of directors or similar governing body, manage or
30	30	7 regulate a residential subdivision, planned unit
31	31	8 development, condominium or townhouse development,
32	32	9 cooperative, mobile home association, nonprofit land trust
33	33	10 or similar planned residential development.

35	35	12 (b) Except as otherwise provided by this section, no
36	36	13 homeowners' association shall prohibit the indoor or
37	37	14 outdoor display of a campaign sign, including any flag,
38	38	15 advertising a candidate for nomination or election to
39	39	16 public office or a clearly identified ballot proposition
40	40	17 for an election.

42	42	19 (c) Nothing in this section shall prohibit a
43	43	20 homeowners' association from establishing regulations that
44	44	21 are in accordance with the homeowners' association's bylaws
45	45	22 or other governing document for campaign signs that:

47	47	2 be ground-mounted or attached to a fence on the homeowners'
48	48	3 association member's property;

50	50	5 (ii) Limit a property owner to displaying not
51	51	6 more than one (1) sign for each candidate or ballot
52	52	7 proposition;

54	54	9 (iii) Are displayed earlier than ninety (90)
55	55	10 days before the date of the primary election;

57	57	12 (iv) Are displayed later than thirty (30) days
58	58	13 after the date of the general election;

60	60	15 (v) Are attached in any way to plant material, a
61	61	16 traffic control device, a light, a trailer or a vehicle;

63	63	18 (vi) Include the painting of architectural
64	64	19 surfaces;

73	73	7 that would be obscene pursuant to W.S. 6-4-301(a)(iii); or

76	76	10 by streamers or are otherwise distracting to motorists.

79	79	13 a campaign sign in accordance with the association's bylaws
80	80	14 or governing document that is displayed in violation of a
81	81	15 regulation allowed by this section.

87	87	21 (a) Unless a different penalty is specifically
88	88	22 provided in this code, the following acts, if knowingly and

91	91	2 not more than one thousand dollars ($1,000.00), or both:

93	93	4 (ix) Violating W.S. 22-25-101 through

96	96	7This act shall apply to any homeowners'
97	97	8 association created or creating new legal requirements with
98	98	9 owners of property within the association on or after July
99	99	10 1, 2025.
