signs.

A BILL
for
1 AN ACT relating to elections; limiting regulation by 
2 homeowner's associations for the display of campaign signs 
3 on association members' property; providing exceptions; 
4 providing a definition; providing for a penalty; and 
5 providing for an effective date.

13 2025STATE OF WYOMING25LSO-05592HB03391 (a)  As used in this section, "homeowners' 
2 association" means any incorporated or unincorporated 
3 association that is owned by or whose members consist 
4 primarily of the owners of property governed by an 
5 enforceable legal document through which the owners, or the 
6 board of directors or similar governing body, manage or 
7 regulate a residential subdivision, planned unit 
8 development, condominium or townhouse development, 
9 cooperative, mobile home association, nonprofit land trust 
10 or similar planned residential development.

12 (b)  Except as otherwise provided by this section, no 
13 homeowners' association shall prohibit the indoor or 
14 outdoor display of a campaign sign, including any flag, 
15 advertising a candidate for nomination or election to 
16 public office or a clearly identified ballot proposition 
17 for an election.

19 (c)  Nothing in this section shall prohibit a 
20 homeowners' association from establishing regulations that 
21 are in accordance with the homeowners' association's bylaws 
22 or other governing document for campaign signs that:

2 be ground-mounted or attached to a fence on the homeowners' 
3 association member's property;

5 (ii)  Limit a property owner to displaying not 
6 more than one (1) sign for each candidate or ballot 
7 proposition;

9 (iii)  Are displayed earlier than ninety (90) 
10 days before the date of the primary election;
11
12 (iv)  Are displayed later than thirty (30) days 
13 after the date of the general election;
14
15 (v)  Are attached in any way to plant material, a 
16 traffic control device, a light, a trailer or a vehicle;
17
18 (vi)  Include the painting of architectural 
19 surfaces;
20
21 (vii)  Threaten public health or safety;

2 feet;

4 (ix)  Violate a law;
5
6 (x)  Contain language, graphics or any display 
7 that would be obscene pursuant to W.S. 6-4-301(a)(iii); or

9 (xi)  Are accompanied by music or other sounds or 
10 by streamers or are otherwise distracting to motorists.

12 (d)  A homeowners' association may request removal of 
13 a campaign sign in accordance with the association's bylaws 
14 or governing document that is displayed in violation of a 
15 regulation allowed by this section.

17W.S. 22-26-112(a)(ix) is amended to read:

21 (a)  Unless a different penalty is specifically 
22 provided in this code, the following acts, if knowingly and

1 not more than six (6) months in a county jail or a fine of 
2 not more than one thousand dollars ($1,000.00), or both:

4 (ix)  Violating W.S. 22-25-101 through 
5;

7This act shall apply to any homeowners' 
8 association created or creating new legal requirements with 
9 owners of property within the association on or after July 
10 1, 2025.
