26	26	4 (a) Electric utilities shall compensate new small
27	27	5 customer-generators in accordance with subsections (b) and
28	28	6 (c) of this section.

30	30	8 (b) The public service commission shall establish an
31	31	9 appropriate compensation system to regulate the rates,
32	32	10 terms and conditions applied to new small
33	33	11 customer-generators by electric utilities for electricity
34	34	12 produced by new small customer-generators. The compensation
35	35	13 system shall provide for just and reasonable rates, terms
36	36	14 and conditions.

38	38	16 (c) Any cooperative electric utility that is exempt
39	39	17 from retail rate regulation by the public service
40	40	18 commission under chapter 17, title 37 of the Wyoming
41	41	19 statutes shall not be subject to subsection (b) of this
42	42	20 section and the board of directors of a cooperative
43	43	21 electric utility shall, not later than January 1, 2026,
44	44	22 adopt rates, terms and conditions to compensate new small

47	47	2 (i) Give written notice to all of its member
48	48	3 owners, not less than thirty (30) days prior to the
49	49	4 effective date of the cooperative's initial rates, terms
50	50	5 and conditions regarding compensation of new small
51	51	6 customer-generators and of the effective date of any
52	52	7 subsequent change to the rates, terms and conditions,
53	53	8 including procedures for the cooperative's member owners to
54	54	9 comment on proposed rates;

56	56	11 (ii) Rates, terms and conditions adopted by a
57	57	12 cooperative electric utility in accordance with this
58	58	13 subsection shall be filed with the commission; and

60	60	15 (iii) Be subject to the complaint, investigation
61	61	16 and resolution process pursuant to W.S. 37-17-104(d) and
62	62	17 (e) regarding the rates, terms and conditions adopted by
63	63	18 the board to compensate new small customer-generators.

110	110	19 under this act shall not be considered a "public utility"
111	111	20 as defined by W.S. 37-1-101.

116	116	3 (i) Shall offer to make available to each of its
117	117	4 eligible customer-generators

119	119	6 registering the flow of electricity in two (2) directions;

121	121	8 (ii) May, at its own expense and with the
122	122	9 install one (1)
123	123	10 or more additional meters to monitor the flow of
124	124	11 electricity in each direction;

126	126	13 (iii) Except as otherwise provided in this
127	127	14hall not charge
128	128	15 customer-generator any fee or charge that would increase
129	129	16 the customer-generator's minimum monthly
130	130	17 charge to an amount greater than that of other customers of
131	131	18 the electric utility in the same rate class as the
132	132	19 customer-generator.

136	136	2 the net energy measurement
137	137	3 shall be calculated in the following
138	138	4 manner:

140	140	6 (ii) If the electricity supplied by the electric
141	141	7 utility exceeds the electricity generated by the
142	142	8, the

144	144	10 appropriate customer charges for that month, in accordance
145	145	11 with W.S. 37-16-102;

147	147	13 (iii) If the electricity supplied by the
148	148	14
149	149	15 the electric utility, the customer-generator
150	150	16 shall be credited
151	151	17 kilowatt-hours generated during the month with the
152	152	18 kilowatt-hour credit or compensation appearing on the bill
153	153	19 for the following month for all metered locations of
154	154	20 customer-generators supplied by the electric
155	155	21 utility.

158	158	3 kilowatt-hour credit accumulated during the previous year
159	159	4 shall be sold to the electric utility, at the electric
160	160	5 utility's filed avoided cost.

164	164	9 (a) A net metering system
165	165	10 used by a customer-generator shall
166	166	11 meet all applicable safety and performance standards
167	167	12 established by the national electrical code, the institute
168	168	13 of electrical and electronics engineers and underwriters
169	169	14 laboratories.

171	171	16 (b) The customer-generator shall at its expense
172	172	17 provide lockable, switching equipment capable of isolating
173	173	18 the
174	174	19 from the electric utility's system. Such equipment
175	175	20 shall be approved by the electric utility and shall be
176	176	21 accessible by the electric utility at all times.

178	178	2 or indirectly for permitting or continuing to allow an
179	179	3 attachment of a
180	180	4, or for acts or omissions of the
181	181	5 customer-generator that cause loss or injury, including
182	182	6 death, to any third party.

184	184	8 (d) The customer-generator is responsible for
185	185	9 all costs associated with its facility and is also
186	186	10 responsible for all costs related to any modifications to
187	187	11 the facility that may be required by the electric utility
188	188	12 for safety and reliability.

190	190	14 (e) The commission, after appropriate notice and
191	191	15 opportunity for comment, may adopt by regulation additional
192	192	16 control and testing requirements for
193	193	17 customer-generators that the commission determines are
194	194	18 necessary safety and
195	195	19 reliability.

197	197	21The public service commission of Wyoming
198	198	22 shall conduct public hearings related to the implementation
199	199	23 of the compensation system for electricity produced from 2025STATE OF WYOMING25LSO-054910SF0111
200	200	1 new small customer-generators and
201	201	2 necessary to implement the system as provided in W.S.
202	202	3 37-16-105(b) not later than December 31, 2025. Any
203	203	4 cooperative electric utility that is exempt from retail
204	204	5 rate regulation by the public service commission under
205	205	6 chapter 17, title 37 of the Wyoming statutes shall adopt
206	206	7 rates, terms and conditions to compensate small
207	207	8 customer-generators as provided in W.S. 37-16-105(c) not
208	208	9 later than January 1, 2026.

210	210	11. This act is effective immediately upon
211	211	12 completion of all acts necessary for a bill to become law
212	212	13 as provided by Article 4, Section 8 of the Wyoming
213	213	14 Constitution.
