7-AN ACT relating to marketing homemade foods; providing for
8-the sale of producer-raised, homemade meat products as
9-specified; providing a delayed effective date pending
10-certification by the governor based on federal action;
11-providing definitions; authorizing rulemaking; and
12-providing for an effective date.
13-Be It Enacted by the Legislature of the State of Wyoming:
14-Section 1. W.S. 11-49-102(a) by creating a new
15-paragraph (xiii) and by renumbering (xiii) as (xiv) and
16-11-49-103(c)(v) by creating a new subparagraph (G) and by
17-creating new subsections (n) and (o) are amended to read:
18-11-49-102. Definitions.
19-(a) As used in this act:
20-(xiii) "Custom slaughter facility" means a
21-slaughter facility that does not have a state or federal
22-inspector on duty and where any meat produced from the
23-facility is not considered to be state or federally
24-inspected meat products;

29-(c) Transactions under this act shall:
30-(v) Not involve the sale of meat products, with

36-2 (G) The sale of meat products under
37-subsection (n) of this section, subject to subsection (o)
38-of this section.
39-(n) Except as prohibited by federal law and subject
40-to subsection (o) of this section, a producer may sell meat
41-products from cattle, sheep, swine or goats raised by the
42-producer that were slaughtered on the premises of the
43-producer or at a custom slaughter facility, if all of the
44-following conditions are met:
45-(i) The meat products are produced from animals
46-that are raised, slaughtered, processed and sold in
47-Wyoming;
48-(ii) The meat products are sold directly to an
49-informed end consumer in Wyoming, whether for consumption
50-on or off the premises of the producer;
51-(iii) A prominent written warning statement is
52-delivered to the informed end consumer at the time of sale,
53-or the warning is displayed on a label affixed to the meat
54-product packaging. The warning required by this paragraph
55-shall state:
56-(A) The meat product has not been inspected
57-and is not regulated;
58-(B) An informed end consumer who obtains
59-meat products under this act agrees not to sell, donate or
60-commercially redistribute the meat;
61-(C) Information describing the standards
62-used by the producer with respect to animal health and in
63-the processing of meat from the animal. ORIGINAL SENATE

69-(iv) The producer shall not publish any
70-statement associated with the meat that implies or states
71-the Wyoming department of agriculture's approval or
72-endorsement of meat delivered under this subsection.
73-(o) Subsection (n) of this section shall be effective
74-on the date that the governor, on advice of the attorney
75-general, certifies to the secretary of state that the sale
76-of meat products from cattle, sheep, swine or goats raised
77-by the producer that were slaughtered on the premises of
78-the producer or at a custom slaughter facility is legalized
79-under federal law. Legalization under federal law shall
80-constitute either the passage of a federal law that allows
81-direct-to-consumer sales of uninspected meat products or
82-the issuance of a final decision by a federal court with
83-jurisdiction over this state that declares that the federal
84-prohibition on direct-to-consumer sales is unconstitutional
85-or otherwise invalid. Sales of meat products under
86-subsection (n) of this section shall be allowed upon the
87-governor's certification to the secretary of state that
88-sales of uninspected meat products have been legalized
89-under federal law.
90-Section 2.
91-(a) Upon certification by the governor that W.S.
92-11-49-103(n), as created by section 1 of this act, is
93-effective:
94-(i) The department of agriculture may promulgate

100-4(ii) Producers may sell meat products
101-immediately upon certification in accordance with W.S.
102-11-49-103(n) and (o), as created by section 1 of this act.
103-Section 3. This act is effective July 1, 2025.
