2929 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3
3030 * Section 1. AS 21.42.375(e) is amended to read: 4
3131 (e) In this section, 5
3232 (1) "diagnostic breast examination" means an examination of the

3434 breast using contrast-enhanced mammography, diagnostic mammography, 7
3535 breast magnetic resonance imaging, breast ultrasound, or other equipment 8
3636 dedicated specifically for mammography conducted to evaluate an abnormality 9
3737 (A) detected or suspected in a screening examination for 10
3838 breast cancer; or 11
3939 (B) detected by another means of examination; 12
4040 (2) "low-dose mammography screening" and "mammogram" mean the 13

4545 mammography, including the X-ray tube, filter, compression device, screens, films, 1
4646 and cassettes, with an average radiation exposure delivery of less than one rad mid-2

4848 (3) "supplemental breast examination" means an examination of 4
4949 the breast using contrast-enhanced mammography, diagnostic mammography, 5
5050 breast magnetic resonance imaging, breast ultrasound, or other equipment 6

5252 (A) the insured's personal or family medical history of 8

5454 (B) other factors that may increase the insured's risk of 10

5656 * Sec. 2. AS 21.42.375 is amended by adding a new subsection to read: 12
5757 (f) Except as necessary to qualify a plan as a high deductible health plan 13
5858 eligible for a health savings account tax deduction under 26 U.S.C. 223 (Internal 14
5959 Revenue Code), a health care insurer that offers, issues, delivers, or renews a health 15
6060 care insurance plan in the individual or group market in the state that provides 16
6161 coverage for mammography screening, diagnostic breast examinations, and 17
6262 supplemental breast examinations may not impose cost sharing, a deductible, 18
6363 coinsurance, a copayment obligation, or another similar out-of-pocket expense on an 19
6464 insured for coverage of a low-dose mammography screening, diagnostic breast 20
6565 examination, or supplemental breast examination. 21
6666 * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 22

6868 APPLICABILITY. AS 21.42.375(e), as amended by sec. 1 of this Act, and 24
6969 AS 21.42.375(f), added by sec. 2 of this Act, apply to an insurance policy or contract issued, 25

7373 TRANSITION: REGULATIONS. The director of the division of insurance may adopt 29
7474 regulations necessary to implement this Act. The regulations take effect under AS 44.62 30
