FOR AN ACT ENTITLED 
 
"An Act relating to insurance; relating to mammograms; and providing for an effective 1 
date." 2 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3 
   * Section 1. AS 21.42.375(e) is amended to read: 4 
(e)  In this section,  5 
(1)  "diagnostic breast examination" means an examination of the 
6 
breast using contrast-enhanced mammography, diagnostic mammography, 7 
breast magnetic resonance imaging, breast ultrasound, or other equipment 8 
dedicated specifically for mammography conducted to evaluate an abnormality 9 
(A) detected or suspected in a screening examination for 10 
breast cancer; or 11 
(B)  detected by another means of examination; 12 
(2)  "low-dose mammography screening" and "mammogram" mean the 13 
X-ray examination of the breast using equipment dedicated specifically for 14    33-LS1030\B

mammography, including the X-ray tube, filter, compression device, screens, films, 1 
and cassettes, with an average radiation exposure delivery of less than one rad mid-2 
breast, with two views for each breast; 3 
(3)  "supplemental breast examination" means an examination of 4 
the breast using contrast-enhanced mammography, diagnostic mammography, 5 
breast magnetic resonance imaging, breast ultrasound, or other equipment 6 
dedicated specifically for mammography conducted based on  7 
(A)  the insured's personal or family medical history of 8 
breast cancer; or 9 
(B)  other factors that may increase the insured's risk of 10 
breast cancer.  11 
   * Sec. 2. AS 21.42.375 is amended by adding a new subsection to read: 12 
(f) Except as necessary to qualify a plan as a high deductible health plan 13 
eligible for a health savings account tax deduction under 26 U.S.C. 223 (Internal 14 
Revenue Code), a health care insurer that offers, issues, delivers, or renews a health 15 
care insurance plan in the individual or group market in the state that provides 16 
coverage for mammography screening, diagnostic breast examinations, and 17 
supplemental breast examinations may not impose cost sharing, a deductible, 18 
coinsurance, a copayment obligation, or another similar out-of-pocket expense on an 19 
insured for coverage of a low-dose mammography screening, diagnostic breast 20 
examination, or supplemental breast examination. 21 
   * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 22 
read: 23 
APPLICABILITY. AS 21.42.375(e), as amended by sec. 1 of this Act, and 24 
AS 21.42.375(f), added by sec. 2 of this Act, apply to an insurance policy or contract issued, 25 
delivered, or renewed on or after the effective date of secs. 1 and 2 of this Act. 26 
   * Sec. 4. The uncodified law of the State of Alaska is amended by adding a new section to 27 
read: 28 
TRANSITION: REGULATIONS. The director of the division of insurance may adopt 29 
regulations necessary to implement this Act. The regulations take effect under AS 44.62 30 
(Administrative Procedure Act), but not before the effective date of the law implemented by 31    33-LS1030\B

the regulation. 1 
   * Sec. 5. Section 4 of this Act takes effect immediately under AS 01.10.070(c). 2 
   * Sec. 6. Except as provided in sec. 5 of this Act, this Act takes effect January 1, 2025. 3
