FOR AN ACT ENTITLED 
 
"An Act relating to special request specialty organization registration plates; relating to 1 
special registration plates commemorating peace officers killed in the line of duty; 2 
relating to special registration plates for vehicles owned by women veterans; relating to 3 
special request registration plates for United States Space Force personnel; relating to 4 
the transfer of vehicles; relating to commercial driver's licenses and commercial 5 
instruction permits; and providing for an effective date." 6 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 7 
   * Section 1. AS 28.10.181 is amended by adding new subsections to read: 8 
(ll)  Special request specialty organization plates. The department shall adopt 9 
regulations to allow for the issuance of special request specialty organization 10 
registration plates sponsored by an organization that is based in this state and is tax 11 
exempt under 26 U.S.C. 501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - 12 
(29), is an Alaska chapter of a national organization that is tax exempt under 26 U.S.C. 13    33-LS0517\D

501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - (29), is a department of 1 
the state, or is a municipality of the state. The department shall determine a common 2 
design and color for the plates and provide for the placement of the logo of the 3 
organization and a short piece of descriptive text on the plate. If the department denies 4 
an application to create a specialty organization registration plate under this section, 5 
the department shall notify the commissioner of the denial. The commissioner may 6 
reverse the decision of the department and require issuance of the requested plate. The 7 
department may disapprove the issuance of registration plates under this subsection 8 
when the requested plates duplicate an existing registration. Regulations adopted 9 
under this subsection must 10 
(1)  provide that the entity requesting the issuance of the plates  11 
(A) submit an application on a form provided by the 12 
department; 13 
(B)  pay an application fee set by the department for issuance of 14 
the new registration plates; 15 
(C)  pay the entire cost of developing and issuing the specialty 16 
plate; 17 
(D)  may not be offensive in purpose, nature, activity, or name; 18 
(E) may charge a fee for issuance of a specialty registration 19 
plate in addition to any registration fees set by statute or regulation; 20 
(2)  provide for notice to the entity sponsoring the plate not later than 21 
six months before a proposed cancellation of the specialty organization plate; 22 
(3)  establish procedures for owners of vehicles to purchase specialty 23 
organization registration plates under this subsection. 24 
(mm)  Special request plates commemorating peace officers killed in the line 25 
of duty. Upon application by the owner of a motor vehicle, the department may issue 26 
registration plates commemorating peace officers killed in the line of duty. The 27 
commissioner, after consulting with representatives of peace officers killed in the line 28 
of duty, shall determine the design and color of the plates. The department may 29 
disapprove the issuance of registration plates under this subsection when the requested 30 
plates are a duplication of an existing registration. In this subsection, "peace officer" 31    33-LS0517\D

means  1 
(1)  an officer of the state troopers; 2 
(2)  a member of the police force of a municipality; 3 
(3)  a correctional officer; 4 
(4)  a village public safety officer; 5 
(5)  an officer assigned to a court to serve warrants and court orders, 6 
provide court security and judicial protection, and transport prisoners; and 7 
(6)  any other public servant vested by law with a duty to maintain 8 
public order or to make arrests, whether the duty extends to all offenses or is limited to 9 
a specific class of offenses or offenders. 10 
(nn) Vehicles owned by women veterans. The department, upon receipt of 11 
written proof that the woman veteran is a sole or joint owner of a motor vehicle, shall 12 
issue special registration plates for the motor vehicle to a requesting person who is a 13 
woman veteran or retired woman veteran of the armed forces of the United States.  14 
(oo) Special request plates for United States Space Force personnel. Upon 15 
application by the owner of a motor vehicle who presents satisfactory proof of current 16 
membership in the Unites States Space Force, the department may design and issue 17 
registration plates that identify the vehicle as registered to a member of the United 18 
States Space Force. The department may disapprove the issuance of registration plates 19 
under this subsection when the requested plates are a duplication of an existing 20 
registration. 21 
   * Sec. 2. AS 28.10.421(d)(2) is amended to read: 22

(A) Alaska National Guard or United States Space Force 24

paragraph shall be collected only on the first issuance and on the replacement of 5

   * Sec. 3. AS 28.10.421(d) is amended by adding new paragraphs to read: 7 
(26) special request specialty organization plates under 8

fee required by this paragraph shall be collected only on the first issuance of and the 11 
replacement of the plates; in addition, an entity sponsoring a special request specialty 12 
organization plate may charge a fee on first issuance and renewal of the plates; 13 
(27)  special request plates commemorating peace officers killed in the 14

required by this paragraph shall be collected biennially in the same manner as the fee 17 
required under (b), (c), (h), or (i) of this section. 18 
   * Sec. 4. AS 28.15.031(c) is amended to read: 19 
(c)  The department may not issue an original or duplicate commercial driver's 20 
license to, nor renew or reinstate the commercial driver's license of, a person who is 21 
disqualified from operating commercial motor vehicles in this or any other jurisdiction 22 
[OR IS NOT DOMICILED IN THIS STATE].  23 
   * Sec. 5. AS 28.15.051(f) is amended to read: 24 
(f)  A person who is at least 18 years of age may apply to the department for a 25 
domiciled commercial instruction permit. The department may, after the applicant has 26 
successfully passed all parts of the examination under AS 28.15.081 other than the 27 
driving test, issue to the applicant a domiciled commercial instruction permit. The 28 
permit allows a person, while having the permit in the person's immediate possession, 29 
to drive a specified commercial type or class of motor vehicle on a highway or 30 
vehicular way or area for a period not to exceed 180 days. The permittee shall be 31    33-LS0517\D

accompanied by a person at least 21 years of age who has been licensed at least one 1 
year to drive the type or class of vehicle being used, who is capable of exercising 2 
control over the wheel, and who occupies a seat beside the driver. A domiciled 3 
commercial instruction permit may be renewed one time for a period of 180 days. 4 
Once a license is issued to drive a specified type or class of motor vehicle, a driver is 5 
not eligible to obtain a domiciled commercial instruction [INSTRUCTIONAL] 6 
permit for that specified type or class of motor vehicle unless 7 
(1)  five years have passed since the expiration of the previous license; 8 
or  9 
(2) the domiciled commercial instruction permit is obtained for the 10 
purpose of adding an endorsement to a current class of commercial license.  11 
   * Sec. 6. AS 28.15.051 is amended by adding a new subsection to read:  12 
(g)  A person who is at least 18 years of age may apply to the department for a 13 
non-domiciled commercial instruction permit. The department may, after the applicant 14 
has successfully passed all parts of the examination under AS 28.15.081 other than the 15 
driving test, issue to the applicant a non-domiciled commercial instruction permit if 16 
the applicant is domiciled in a foreign jurisdiction or another state, the department 17 
determines that the commercial motor vehicle testing and licensing standards of the 18 
other jurisdiction meet the requirements of federal law, and the applicant satisfies the 19 
requirements of AS 28.33.100(a)(2)(B) - (D). The permit allows a person, while 20 
having the permit in the person's immediate possession, to drive a specified 21 
commercial type or class of motor vehicle on a highway or vehicular way or area for a 22 
period not to exceed one year. The permittee shall be accompanied by a person at least 23 
21 years of age who has been licensed at least one year to drive the type or class of 24 
vehicle being used, who is capable of exercising control over the wheel, and who 25 
occupies a seat beside the driver. A non-domiciled commercial instruction permit must 26 
be marked with "non-domiciled" on the face of the document. A non-domiciled 27 
commercial instruction permit expires on the earlier of the expiration date determined 28 
by the United States Department of Homeland Security that is stated on the form 29 
required for the applicant under AS 28.33.100(a)(2)(B) or one year from the date of 30

driver is not eligible to obtain a non-domiciled commercial instruction permit for that 1 
specified type or class of motor vehicle unless  2 
(1)  five years have passed since the expiration of the previous license; 3 
or  4 
(2) the non-domiciled commercial instruction permit is obtained for 5 
the purpose of adding an endorsement to a current class of commercial license. 6 
   * Sec. 7. AS 28.22.031 is amended by adding a new subsection to read: 7 
(c)  The department shall review all accident reports and shall request proof of 8 
insurance from a vehicle owner or operator in each case in which evidence of motor 9 
vehicle liability insurance that complies with this chapter is not present. 10 
   * Sec. 8. AS 28.33.100(a) is amended to read: 11 
(a) A person may not drive a commercial motor vehicle until the person 12 
applies for and is issued a license for that purpose under AS 28.15.041. The 13 
department may [NOT] issue a  14 
(1) domiciled license to drive a commercial motor vehicle only if 15 
[UNLESS] the applicant  16 
(A) [(1)] is at least 18 years of age, to operate in intrastate 17 
commerce, or at least 21 years of age, to operate in interstate commerce, 18 
except as provided in (f) of this section;  19 
(B) [(2)]  has successfully completed all required driving tests 20 
and written and physical examinations;  21 
(C) [(3)]  either does not have a driver's license issued by 22 
another jurisdiction or surrenders all driver's licenses issued by other 23 
jurisdictions; and  24 
(D) [(4)]  is domiciled in this state; 25 
(2)  non-domiciled license to drive a commercial motor vehicle if 26 
the applicant 27 
(A)  is domiciled in 28 
(i)  a foreign jurisdiction that meets the requirements 29 
set out in 49 C.F.R. 383.23(b)(1); or 30 
(ii)  another state that meets the requirements set out 31    33-LS0517\D

in 49 C.F.R. 383.23(b)(2); and 1 
(B)  meets the applicable requirements set out in 2 
AS 28.33.100(a) and 49 C.F.R. 383.71 3 
(C) is at least 18 years of age, to operate in intrastate 4 
commerce, or at least 21 years of age, to operate in interstate commerce, 5 
except as provided in (f) of this section; and  6 
(D) has successfully completed all required driving tests 7 
and written and physical examinations. 8 
   * Sec. 9. AS 28.33.100 is amended by adding new subsections to read:  9 
(g)  A non-domiciled commercial driver's license must be marked with "non-10 
domiciled" on the face of the document. 11 
(h)  A non-domiciled commercial driver's license expires  12 
(1)  for an applicant under (a)(2)(A)(i) of this section, on the earlier of 13 
(A) the expiration date determined by the United States 14 
Department of Homeland Security that is stated on the form required for the 15 
applicant under 49 C.F.R. 383.71(f)(2)(i); or  16 
(B)  one year from the date of issuance; 17 
(2)  for an applicant under (a)(2)(A)(ii) of this section, one year from 18 
the date of issuance.  19 
(i) In addition to the requirements under (a) of this 20 
section, the holder of a non-domiciled commercial driver's license shall 21 
notify the department of any adverse action taken by a foreign or 22 
domestic jurisdiction or governmental agency against the person's 23 
driving privileges as required by federal law. 24 
   * Sec. 10. AS 28.39.040(c) is amended to read: 25 
(c)  The department shall, upon assignment of a registration number, issue and 26 
deliver to the owner a certificate of registration in a form prescribed by the 27 
department. [A CERTIFICATE OF REGISTRATION IS NOT VALID UNLESS IT 28 
IS SIGNED BY THE PERSON WHO SIGNED THE APPLICATION FOR 29 
REGISTRATION.]  30

(a)  If there is a change of ownership of a snowmobile, the [SELLER AND] 1 
buyer shall [FILL OUT THE TRANSFER OF OWNERSHIP SECTION OF THE 2 
REGISTRATION, AND THE SELLER SHALL SIGN OVER THE 3 
REGISTRATION TO THE NEW OWNER. THE SELLER SHALL] promptly submi t 4 
an application for registration [THE TRANSFER OF OWNERSHIP SECTION] to 5 
the department, and, if the application meets the requirements set out in this 6 
chapter and in regulation, the department shall issue a new certificate of registration 7 
to the new owner. 8 
   * Sec. 12. AS 28.90.990(a) is amended by adding new paragraphs to read: 9 
(33) "commercial driver's license" includes a non-domiciled 10 
commercial driver's license; 11 
(34) "commercial learner's permit" includes a non-domiciled 12 
commercial learner's permit. 13 
   * Sec. 13. AS 28.33.190(9) is repealed. 14 
   * Sec. 14. This Act takes effect immediately under AS 01.10.070(c). 15
