	31	+	the transfer of vehicles; relating to commercial driver's licenses and commercial 5
	32	+	instruction permits; and providing for an effective date." 6
	33	+	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 7
63	34		* Section 1. AS 28.10.181 is amended by adding new subsections to read: 8
64	35		(ll) Special request specialty organization plates. The department shall adopt 9
65	36		regulations to allow for the issuance of special request specialty organization 10
66	37		registration plates sponsored by an organization that is based in this state and is tax 11
67	38		exempt under 26 U.S.C. 501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - 12
68		-	(29), is an Alaska chapter of a national organization that is tax exempt under 26 U.S.C. 13

70	43		501(c)(2) - (11), 12(B) - (J), (13), (17) - (22), (24), or (26) - (29), is a department of 1
71	44		the state, or is a municipality of the state. The department shall determine a common 2
72	45		design and color for the plates and provide for the placement of the logo of the 3
73	46		organization and a short piece of descriptive text on the plate. If the department denies 4
74	47		an application to create a specialty organization registration plate under this section, 5
75	48		the department shall notify the commissioner of the denial. The commissioner may 6
76	49		reverse the decision of the department and require issuance of the requested plate. The 7
77	50		department may disapprove the issuance of registration plates under this subsection 8
78	51		when the requested plates duplicate an existing registration. Regulations adopted 9
79	52		under this subsection must 10
80	53		(1) provide that the entity requesting the issuance of the plates 11
81	54		(A) submit an application on a form provided by the 12
82	55		department; 13
83	56		(B) pay an application fee set by the department for issuance of 14
84	57		the new registration plates; 15
85	58		(C) pay the entire cost of developing and issuing the specialty 16
86	59		plate; 17
87	60		(D) may not be offensive in purpose, nature, activity, or name; 18
88	61		(E) may charge a fee for issuance of a specialty registration 19
89	62		plate in addition to any registration fees set by statute or regulation; 20
90	63		(2) provide for notice to the entity sponsoring the plate not later than 21
91	64		six months before a proposed cancellation of the specialty organization plate; 22
92	65		(3) establish procedures for owners of vehicles to purchase specialty 23
93	66		organization registration plates under this subsection. 24
94	67		(mm) Special request plates commemorating peace officers killed in the line 25
95	68		of duty. Upon application by the owner of a motor vehicle, the department may issue 26
96	69		registration plates commemorating peace officers killed in the line of duty. The 27
97	70		commissioner, after consulting with representatives of peace officers killed in the line 28
98	71		of duty, shall determine the design and color of the plates. The department may 29
99	72		disapprove the issuance of registration plates under this subsection when the requested 30

103	78		(1) an officer of the state troopers; 2
104	79		(2) a member of the police force of a municipality; 3
105	80		(3) a correctional officer; 4
106	81		(4) a village public safety officer; 5
107	82		(5) an officer assigned to a court to serve warrants and court orders, 6
108	83		provide court security and judicial protection, and transport prisoners; and 7
109	84		(6) any other public servant vested by law with a duty to maintain 8
110	85		public order or to make arrests, whether the duty extends to all offenses or is limited to 9
111	86		a specific class of offenses or offenders. 10
112	87		(nn) Vehicles owned by women veterans. The department, upon receipt of 11
113	88		written proof that the woman veteran is a sole or joint owner of a motor vehicle, shall 12
114	89		issue special registration plates for the motor vehicle to a requesting person who is a 13
115	90		woman veteran or retired woman veteran of the armed forces of the United States. 14
116	91		(oo) Special request plates for United States Space Force personnel. Upon 15
117	92		application by the owner of a motor vehicle who presents satisfactory proof of current 16
118	93		membership in the Unites States Space Force, the department may design and issue 17
119	94		registration plates that identify the vehicle as registered to a member of the United 18
120	95		States Space Force. The department may disapprove the issuance of registration plates 19
121	96		under this subsection when the requested plates are a duplication of an existing 20
122	97		registration. 21

161	138		driving test, issue to the applicant a domiciled commercial instruction permit. The 28
162	139		permit allows a person, while having the permit in the person's immediate possession, 29
163	140		to drive a specified commercial type or class of motor vehicle on a highway or 30

166	145		accompanied by a person at least 21 years of age who has been licensed at least one 1
167	146		year to drive the type or class of vehicle being used, who is capable of exercising 2
168	147		control over the wheel, and who occupies a seat beside the driver. A domiciled 3
169	148		commercial instruction permit may be renewed one time for a period of 180 days. 4
170	149		Once a license is issued to drive a specified type or class of motor vehicle, a driver is 5
171	150		not eligible to obtain a domiciled commercial instruction [INSTRUCTIONAL] 6
172	151		permit for that specified type or class of motor vehicle unless 7
173	152		(1) five years have passed since the expiration of the previous license; 8
174	153		or 9
175	154		(2) the domiciled commercial instruction permit is obtained for the 10
176	155		purpose of adding an endorsement to a current class of commercial license. 11
177	156		* Sec. 6. AS 28.15.051 is amended by adding a new subsection to read: 12
178	157		(g) A person who is at least 18 years of age may apply to the department for a 13
179	158		non-domiciled commercial instruction permit. The department may, after the applicant 14
180	159		has successfully passed all parts of the examination under AS 28.15.081 other than the 15
181	160		driving test, issue to the applicant a non-domiciled commercial instruction permit if 16
182	161		the applicant is domiciled in a foreign jurisdiction or another state, the department 17
183	162		determines that the commercial motor vehicle testing and licensing standards of the 18
184	163		other jurisdiction meet the requirements of federal law, and the applicant satisfies the 19
185	164		requirements of AS 28.33.100(a)(2)(B) - (D). The permit allows a person, while 20
186	165		having the permit in the person's immediate possession, to drive a specified 21
187	166		commercial type or class of motor vehicle on a highway or vehicular way or area for a 22
188	167		period not to exceed one year. The permittee shall be accompanied by a person at least 23
189	168		21 years of age who has been licensed at least one year to drive the type or class of 24
190	169		vehicle being used, who is capable of exercising control over the wheel, and who 25
191	170		occupies a seat beside the driver. A non-domiciled commercial instruction permit must 26
192	171		be marked with "non-domiciled" on the face of the document. A non-domiciled 27
193	172		commercial instruction permit expires on the earlier of the expiration date determined 28
194	173		by the United States Department of Homeland Security that is stated on the form 29
195	174		required for the applicant under AS 28.33.100(a)(2)(B) or one year from the date of 30

199	180		specified type or class of motor vehicle unless 2

206	187		insurance from a vehicle owner or operator in each case in which evidence of motor 9
207	188		vehicle liability insurance that complies with this chapter is not present. 10

209	190		(a) A person may not drive a commercial motor vehicle until the person 12
210	191		applies for and is issued a license for that purpose under AS 28.15.041. The 13

213	194		[UNLESS] the applicant 16
214	195		(A) [(1)] is at least 18 years of age, to operate in intrastate 17
215	196		commerce, or at least 21 years of age, to operate in interstate commerce, 18
216	197		except as provided in (f) of this section; 19
217	198		(B) [(2)] has successfully completed all required driving tests 20
218	199		and written and physical examinations; 21
219	200		(C) [(3)] either does not have a driver's license issued by 22
220	201		another jurisdiction or surrenders all driver's licenses issued by other 23
221	202		jurisdictions; and 24
222	203		(D) [(4)] is domiciled in this state; 25
223	204		(2) non-domiciled license to drive a commercial motor vehicle if 26
224	205		the applicant 27
225	206		(A) is domiciled in 28
226	207		(i) a foreign jurisdiction that meets the requirements 29
227	208		set out in 49 C.F.R. 383.23(b)(1); or 30
228		-	(ii) another state that meets the requirements set out 31

245	228		applicant under 49 C.F.R. 383.71(f)(2)(i); or 16
246	229		(B) one year from the date of issuance; 17
247	230		(2) for an applicant under (a)(2)(A)(ii) of this section, one year from 18
248	231		the date of issuance. 19
249		-	(i) In addition to the requirements under (a) of this section, the holder of a 20
250		-	non-domiciled commercial driver's license shall notify the department of any adverse 21
251		-	action taken by a foreign or domestic jurisdiction or governmental agency against the 22
252		-	person's driving privileges as required by federal law. 23
253		-	* Sec. 10. AS 28.39.040(c) is amended to read: 24
254		-	(c) The department shall, upon assignment of a registration number, issue and 25
255		-	deliver to the owner a certificate of registration in a form prescribed by the 26
