9-2 ENROLLED, An Act,
10-3 Relating to Houston County; to amend Section
11-4 45-35-83.01, Code of Alabama 1975, to provide further for the
12-5 compensation of the judge of probate.
13-6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
14-7 Section 1. Section 45-35-83.01, Code of Alabama
15-8 1975, is amended to read as follows:
16-9 "§45-35-83.01.
17-10 "(a)(1) Beginning on June 1, 2015 the effective date
18-11 of the act amending this section, the Judge of Probate of
19-12 Houston County shall receive an annual salary of one hundred
20-13 five thousand dollars ($105,000). Notwithstanding Chapter 2A
21-14 of Title 11, the judge of probate shall be eligible for any
22-15 cost of living increase afforded to all county employees equal
23-16 to the state salary paid to a district judge, and shall be
24-17 entitled to any increases in salary in the same amount and
25-18 same manner as a district judge possessing the same number of
26-19 cumulative years of service as the probate judge at that time
27-20 possesses.
28-21 "(2) The salary provided by this section shall be in
29-22 lieu of any and all other prior compensation or income, not
30-23 including any expense allowance, provided by law for the judge
31-24 of probate, and shall be paid in equal periodic installments
32-25 from the general fund of the county.

34-1 "(b) In order to receive the compensation provided
35-2 under subsection (a), the judge of probate shall waive any
36-3 compensation provided under Section 17-3-60, relating to
37-4 reports from the state voter registration list."
38-5 Section 2. This act shall become effective on the
39-6 first day of the first month following its passage and
40-7 approval by the Governor, or its otherwise becoming law.
