1 HB79 2 215982-2 3 By Representatives Lee, Clouse, Grimsley and Sorrells (N & P) 4 RFD: Local Legislation 5 First Read: 11-JAN-22 Page 0 HB79 1 2 ENROLLED, An Act, 3 Relating to Houston County; to amend Section 4 45-35-83.01, Code of Alabama 1975, to provide further for the 5 compensation of the judge of probate. 6 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 7 Section 1. Section 45-35-83.01, Code of Alabama 8 1975, is amended to read as follows: 9 "ยง45-35-83.01. 10 "(a)(1) Beginning on June 1, 2015 the effective date 11 of the act amending this section, the Judge of Probate of 12 Houston County shall receive an annual salary of one hundred 13 five thousand dollars ($105,000). Notwithstanding Chapter 2A 14 of Title 11, the judge of probate shall be eligible for any 15 cost of living increase afforded to all county employees equal 16 to the state salary paid to a district judge, and shall be 17 entitled to any increases in salary in the same amount and 18 same manner as a district judge possessing the same number of 19 cumulative years of service as the probate judge at that time 20 possesses. 21 "(2) The salary provided by this section shall be in 22 lieu of any and all other prior compensation or income, not 23 including any expense allowance, provided by law for the judge 24 of probate, and shall be paid in equal periodic installments 25 from the general fund of the county. Page 1 HB79 1 "(b) In order to receive the compensation provided 2 under subsection (a), the judge of probate shall waive any 3 compensation provided under Section 17-3-60, relating to 4 reports from the state voter registration list." 5 Section 2. This act shall become effective on the 6 first day of the first month following its passage and 7 approval by the Governor, or its otherwise becoming law.
