17+SYNOPSIS:
18+Under existing law, a person 14 or 15 years of
19+age is required to obtain an eligibility to work form
20+to be able to work.
21+This bill would eliminate the eligibility to
22+work form.

2026 Relating to child labor; to amend Sections 25-8-32.1
2127 and 25-8-45, Code of Alabama 1975, to eliminate the
2228 eligibility to work form; and to repeal Section 25-8-46, Code
2329 of Alabama 1975, relating to the eligibility to work form.
2430 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2531 Section 1. Sections 25-8-32.1 and 25-8-45, Code of
2632 Alabama 1975, are amended to read as follows:
2733 "§25-8-32.1
2834 For purposes of this chapter, the following words and
2935 phrases shall have the following meanings:
3036 (1) DEPARTMENT. The Department of Labor.
3137 (2) ELIGIBILITY TO WORK FORM. A form issued by the head
3238 administrator, counselor, or, if home schooled an instructor
33-of the school which a 14- or 15-year-old minor attends
34-certifying satisfactory grades and attendance of the minor in
35-order for a 14- or 15-year-old minor to be employed.
36-(3)(2) EMPLOY. To employ, permit, or suffer to work
37-with or without compensation.
38-(4)(3) EMPLOYEE. Any person individual employed by an
39-employer, but shall not include an individual engaged in the

72+(3)(2) EMPLOY. To employ, permit, or suffer to work

74+(4)(3) EMPLOYEE. Any person individual employed by an
6975 employer, but shall not include an individual engaged in the
7076 activities of an educational, charitable, religious,
7177 scientific, historical, literary, or nonprofit organization
7278 where the employer-employee relationship does not in fact
7379 exist or where the services rendered are on a voluntary basis.
7480 (5)(4) EMPLOYER. Any owner or any personindividual,
7581 entity, franchise, corporation, or division of a corporation,
7682 government agency, or association of persons acting directly
7783 as, or in behalf of, or in the interest of any employer in
7884 relation to employees, including the state and any political
7985 subdivision thereof.
8086 (6)(5) SECRETARY. The Secretary of the Department of
8187 Labor.
8288 (7)(6) VIOLATION. A failure by an employer, officer,
8389 agent, or any other person to comply with any applicable
8490 provision of the child labor law."

8692 (a) No person under 16 years of age shall engage in any
8793 occupation mentioned in Section 25-8-39 unless he or she has
8894 secured and has with him or her an eligibility to work form as
8995 provided in this chapter.
9096 (b)(a) No personindividual, entity, franchise,
91-corporation, or division of a corporation shall employ,
92-permit, or suffer to work any personminor 14 or 15 years of
93-age in any occupation, except in agricultural service, unless
94-the personindividual, entity, franchise, corporation, or
95-division of a corporation procures and keeps on file for the
96-inspection by the officials charged with the enforcement of
97-this chapter, an eligibility to work form for every person 14

126+(b)(a) No personindividual, entity, franchise,
127+corporation, or division of a corporation shall employ,
128+permit, or suffer to work any personminor 14 or 15 years of
129+age in any occupation, except in agricultural service, unless
130+the personindividual, entity, franchise, corporation, or
131+division of a corporation procures and keeps on file for the
132+inspection by the officials charged with the enforcement of
127133 this chapter, an eligibility to work form for every person 14
128134 or 15 years of age and a complete list of those
129135 personsindividuals 14 or 15 years of age employed therein with
130136 the employer.
131137 (c)(b) Any personindividual, entity, franchise,
132138 corporation, or division of a corporation that wishes to
133139 employ, permit, or suffer to work any minor 14 or 15 years of
134140 age in any occupation, except in agricultural service, shall
135141 obtain a Class I Child Labor Certificate from the department
136142 for each location where a personan individual, entity,
137143 franchise, corporation, or division of a corporation wishes to
138144 employ a minor 14 or 15 years of age. SuchThe employment shall
139145 be in accordance with all other sections of this chapter.
140146 (d)(c) The certificate shall allow the employment of
141147 minors 14 or 15 years of age to work only outside of school
142148 hours or during vacation periods and only in occupations not
143149 prohibited by this chapter for personsindividuals of these
144150 ages.
145-(c)(d) The employment of a minor 14 or 15 years of age
151+(e)(d) The employment of a minor 14 or 15 years of age
146152 shall be revoked or suspended by the department if the minor's
147153 regular school attendance and performance record is not
148154 satisfactory to the head administrator , or, if home schooled
149-an instructor, of the school which the minor attends. The
150-revocation or suspension shall be processed by the department
151-upon notification by the school.
152-(f)(e) Any personindividual, entity, franchise,
153-corporation, or division of a corporation that wishes to
154-employ, permit, or suffer to work any minor 16 or 17 years of
155-age in any occupation, except in agricultural service, shall

190196 be in accordance with all other sections of this chapter.
191197 (g)(f) The department shall issue Class I and Class II
192198 Child Labor Certificates to any personindividual, entity,
193199 franchise, corporation, or division of a corporation that
194200 applies to the department. The fee for a Class I or Class II
195201 Child Labor Certificate shall be fifteen dollars ($15). The
196202 certificates shall be issued annually.
197203 (h)(g)(1) The application for the child labor
198204 certificate shall contain all of the following information
199205 specific to the location of the minor's employment:
200206 a. The name, address, and telephone number of the
201207 person, entity, franchise, corporation, or division of a
202208 corporation that wishes to employ, permit, or suffer to work
203209 any minor.
204210 b. The type of business or entity, the federal employer
205211 identification number, the names of all incorporators, owners,
206212 members, or partners of the business or entity.
207-c. Any other information as required by department
208-regulation.
209-(2) The Class I and Class II Child Labor Certificates
210-shall contain all of the following information:
211-a. The name of the employer.
212-b. The type of business the employer maintains.

245+(2) The Class I and Class II Child Labor Certificates
246+shall contain all of the following information:
247+a. The name of the employer.
248+b. The type of business the employer maintains.

245251 (3) If a personan individual, entity, franchise,
246252 corporation, or division of a corporation, employs a minor
247253 between 14 and 17 years of age without a proper child labor
248254 certificate, the personindividual, entity, franchise,
249255 corporation or division of a corporation shall pay a penalty
250256 of fifty dollars ($50) and then shall obtain a certificate in
251-the proper manner.
252-(4) The parent, or guardian, of a minor 14 to 15 years
253-old employed by an individual, entity, franchise, corporation,
254-or division of a corporation shall notify the minor's head
255-administrator, counselor, or, if home schooled an instructor
256-of the school which the minor attends of the name, address,
257-and telephone number of the person, entity, franchise,
258-corporation, or division of a corporation employing the
259-minor."

262260 Section 3. This act shall become effective June 1,
