SYNOPSIS:
Under existing law, only an ambulance licensed
by the State Board of Health may transport a patient
who requires a stretcher. An unlicensed medical
transport service may not transport a patient who
requires a stretcher.
This bill would authorize a medical transport
service to transport a patient who requires a
stretcher, gurney, or cot to medical care services in
non-emergency medical circumstances.
This bill would also provide that the State
Board of Health may adopt rules to enforce this
authorization.
A BILL
TO BE ENTITLED
AN ACT
Relating to medical transport services; to authorize a
medical transport service other than a licensed ambulance to
transfer a patient on a stretcher, gurney, or cot in certain
non-emergency medical circumstances; and to authorize the
State Board of Health to adopt rules.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1.(a) The State Board of Health shall not
prohibit an unlicensed non-emergency medical transport service
from transporting a patient on a stretcher, gurney, or cot,
provided that each of the following apply:
(1) The transport vehicle is designed and equipped to
hold a stretcher, gurney, or cot.
(2) The patient is being transported to or from a
medical care facility under non-emergency circumstances,
including transportation to and from medical appointments. For
the purposes of this section, a non-emergency circumstance
exists when the health and life of a patient is not at serious
risk without immediate medical treatment, such as uncontrolled
bleeding, a heart attack, an automobile accident, or other
serious trauma. The State Board of Health may adopt rules
further defining a non-emergency circumstance.
(b) The State Board of Health may adopt rules governing
the operation and conduct of non-emergency medical transport
services and vehicles pursuant to this section.
Section 2. This act shall become effective on October
1, 2024.
