2121 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18

2323 SECTION 1. Arkansas Code ยง 27 -36-204(a)(2), concerning when a motor 20
2424 vehicle is required to display lighted lamps, is amended to read as follows: 21
2525 (2)(A) Every vehicle, except motorcycles and motor -driven 22
2626 cycles, driven upon a street or highway within this state shall display 23
2727 lighted lamps and illuminating devices, as respectively required for 24
2828 different classes of vehicles, during any period in which the vehicle's 25
2929 windshield wipers are being used for clearing or cleaning rain, snow, or 26
3030 other precipitation from th e windshield because of inclement weather. 27
3131 (B)(i) No vehicle or the operator of the vehicle shall be 28
3232 stopped, inspected, or detained solely for violations of the requirements of 29
3333 subdivision (a)(2)(A) of this section. 30
3434 (ii)(B) When any a vehicle operator is stopped by a 31
3535 law enforcement officer and the law enforcement officer notes that the 32
3636 provisions of subdivision (a)(2)(A) of this section have not been violated, 33
3737 any fine levied against the vehicle operator as a result of being stopped 34
3838 shall be reduced by five dollars ($5.00) as an incentive to comply with the 35
3939 provisions of subdivision (a)(2)(A) of this section. 36 HB1324

4444 (C) Any person who violates the provisions of subdivision 1
4545 (a)(2)(A) of this section shall be subject to a fine not to exceed twenty -2
4646 five dollars ($25.00), and, if a person is convicted, pleads guilty, pleads 3
4747 nolo contendere, or forfeits bond for a violation hereof, no court costs or 4
4848 other costs or fees shall be assessed. 5
