BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18 
 19 
 SECTION 1.  Arkansas Code ยง 27 -36-204(a)(2), concerning when a motor 20 
vehicle is required to display lighted lamps, is amended to read as follows: 21 
 (2)(A)  Every vehicle, except motorcycles and motor -driven 22 
cycles, driven upon a street or highway within this state shall display 23 
lighted lamps and illuminating devices, as respectively required for 24 
different classes of vehicles, during any period in which the vehicle's 25 
windshield wipers are being used for clearing or cleaning rain, snow, or 26 
other precipitation from th e windshield because of inclement weather. 27 
 (B)(i)  No vehicle or the operator of the vehicle shall be 28 
stopped, inspected, or detained solely for violations of the requirements of 29 
subdivision (a)(2)(A) of this section. 30 
 (ii)(B) When any a vehicle operator is stopped by a 31 
law enforcement officer and the law enforcement officer notes that the 32 
provisions of subdivision (a)(2)(A) of this section have not been violated, 33 
any fine levied against the vehicle operator as a result of being stopped 34 
shall be reduced by five dollars ($5.00) as an incentive to comply with the 35 
provisions of subdivision (a)(2)(A) of this section. 36     	HB1324

 (C)  Any person who violates the provisions of subdivision 1 
(a)(2)(A) of this section shall be subject to a fine not to exceed twenty	-2 
five dollars ($25.00), and, if a person is convicted, pleads guilty, pleads 3 
nolo contendere, or forfeits bond for a violation hereof, no court costs or 4 
other costs or fees shall be assessed. 5
