 BILL NUMBER: SB 1217AMENDED BILL TEXT AMENDED IN SENATE APRIL 10, 2014 INTRODUCED BY Senator Leno FEBRUARY 20, 2014  An act to amend Section 6217 of the Public Resources Code, relating to state lands.   An act to add Section 12805.4 to the Government Code, relating to climate change.  LEGISLATIVE COUNSEL'S DIGEST SB 1217, as amended, Leno.  State lands: land use revenue.   Climate change: preparedness.   Existing law establishes the Natural Resources Agency and requires the Secretary of the Natural Resources Agency to develop a strategic vision for the Department of Fish and Wildlife and the Fish and Game Commission that includes reforms necessary to take on the challenges of the 21st century, including, among other things, climate change and adaptation. Existing law establishes the Strategic Growth Council and requires the council to, among other things, identify and review activities and funding programs of its member state agencies that may be coordinated to, among other things, meet the goals of the California Global Warming Solutions Act of 2006.   This bill would require the agency, on or before January 1, 2016, and every 2 years thereafter, to prepare a climate risk assessment and strategy evaluation of the state's vulnerability and risk for climate change impacts. The bill would require the council, in consultation with appropriate state agencies, to consider the impacts of climate change on state projects and to identify projects that would provide climate adaptation or resiliency to the state.   Existing law requires the State Lands Commission to deposit in the General Fund all revenue, money, and remittances received by the commission, with the exception of revenue derived from state school lands and other specified sources. Existing law requires that those moneys be made available, upon appropriation, for specified purposes, including refunds, commission expenses, and payments to cities and counties.   This bill would require that at least $10,000,000, but no more than $15,000,000, of those moneys be transferred each year into the Coastal Adaptation Fund, which the bill would create in the State Treasury, for use for the preservation and protection of coastal lands, subject to an appropriation for that purpose in the annual Budget Act.  Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 12805.4 is added to the   Government Code  , to read:   12805.4. (a) On or before January 1, 2016, and every two years thereafter, the Natural Resources Agency shall prepare a climate risk assessment and strategy evaluating California's vulnerability and risk for climate change impacts, such as sea level rise. (b) The Strategic Growth Council shall, in consultation with appropriate state agencies, do both of the following: (1) Consider the impacts of climate change on capital outlay and other state projects. (2) Identify projects that would provide climate adaptation and resiliency to the state.   SECTION 1.   Section 6217 of the Public Resources Code is amended to read: 6217. With the exception of revenue derived from state school lands and from sources described in Sections 6217.6, 6301.5, 6301.6, 6855, and Sections 8551 to 8558, inclusive, and Section 6404 (insofar as the proceeds are from property that has been distributed or escheated to the state in connection with unclaimed estates of deceased persons), the commission shall deposit all revenue, money, and remittances received by the commission under this division, and under Chapter 138 of the Statutes of 1964, First Extraordinary Session, in the General Fund. Out of those funds deposited in the General Fund, sufficient moneys shall be made available each fiscal year for the following purposes: (a) Payment of refunds, authorized by the commission, out of appropriations made for that purpose. (b) Payment of expenditures of the commission as provided in the annual Budget Act. (c) Payments to cities and counties of the amounts specified in Section 6817 for the purposes specified in that section, out of appropriations made for that purpose. (d) Payments to cities and counties of the amounts agreed to pursuant to Section 6875, out of appropriations made for that purpose. (e) At least ten million dollars ($10,000,000), but no more than fifteen million dollars ($15,000,000) of those funds deposited in the General Fund shall be transferred each fiscal year into the Coastal Adaptation Fund, which is hereby created in the State Treasury, for use for the preservation and protection of coastal lands, if an appropriation for that purpose is included in the annual Budget Act.
