14-Be it enacted by the General Assembly of the State of Colorado:
15-SECTION 1. In Colorado Revised Statutes, 24-33.5-216.5, amend
16-(1) and (3); and add (4) and (5) as follows:
17-24-33.5-216.5. Patrol services furnished to the general assembly
18-- definition. (1) The Colorado state patrol shall provide protection for the
19-members of the general assembly when they are present in the state capitol

25+Current law requires the Colorado state patrol to provide
26+protection for members of the general assembly when they are present in
27+the state capitol buildings group and to respond to complaints relating to
28+criminal activity or security threats against a member of the general

52+After considering several factors, the Colorado state patrol determines
53+whether the protection and security services are needed.
54+The bill requires the executive committee of the legislative council
55+(executive committee) to establish a process that allows a member of the
56+general assembly to appeal to the executive committee if the member
57+requests protection and security services from the Colorado state patrol
58+and the Colorado state patrol determines that the services are not needed.
59+The bill requires the executive committee to review the reasons for the
60+request for protection and security services and the reasons for the
61+Colorado state patrol's determination that the services are not needed.
62+If the executive committee determines that the protection and
63+security services requested by the member of the general assembly are
64+needed, the executive committee is required to coordinate with the
65+Colorado state patrol to provide the protection and security services
66+requested by the member of the general assembly. The executive
67+committee is required to reimburse the Colorado state patrol for any costs
68+incurred by the Colorado state patrol in providing protection and security
69+services to a member of the general assembly when the Colorado state
70+patrol or the executive committee determines that the protection and
71+security services are needed. The executive committee is required to
72+authorize the reimbursement from the legislative department cash fund.
73+In addition, the bill specifies that the Colorado state patrol is
74+required to provide the same protection and security services to the
75+secretary of state, attorney general, and state treasurer (statewide
76+constitutional officers) when they are present in the state capitol buildings
77+group as it provides to members of the general assembly and that
78+statewide constitutional officers may also request that the Colorado state
79+patrol provide additional protection and security services to a statewide
80+constitutional officer upon request of the officer.
81+The bill establishes an appeal process for statewide constitutional
82+officers that is similar to the process for members of the general
83+assembly; except that the bill requires the executive director of the
84+department of public safety (director) to establish a process that allows a
85+statewide constitutional officer to appeal to the director. If the director
86+determines that the protection and security services requested by the
87+statewide constitutional officer are needed, the director is required to
88+coordinate with the Colorado state patrol to provide the services and the
89+Colorado state patrol bears the cost of providing the services.
90+If the director determines that the protection and security services
91+requested by a statewide constitutional officer are not needed but the
92+statewide constitutional officer requests that the Colorado state patrol still
93+provide the services, the statewide constitutional officer is required to
94+reimburse the Colorado state patrol for the cost of providing the

149-received from the department of public safety under subsection (1)(a) of this
150-section. To implement this act, the department of personnel may use this
151-appropriation to provide vehicles to the department of public safety.
