1313 WHEREAS, The Bureau of Indian Education (BIE) operates the1
1414 Higher Education Grant Program (grant program) as authorized by the2
1515 federal "Act of November 2, 1921", commonly referred to as the "Snyder3
1616 Act", 25 U.S.C. sec. 13; and4
1717 WHEREAS, Numerous Indian tribal governments provide college5
1818 financial assistance and scholarships from the grant program directly to6
1919 Indian college students through the federal "1975 Indian7
2020 Self-determination and Education Assistance Act", Pub.L. 93-638, or8
2121 through the federal "Tribal Self-governance Act of 1994", Pub.L.9
2222 103-413; and10
2323 WHEREAS, The federal government routinely operates under11
2424 continuing resolutions. As such, grant program funding is delayed;12
2525 consequently, college scholarship and financial assistance payments and13
2626 institutional disbursements are delayed, which is problematic for many14

3933 WHEREAS, There is precedent for forward funding of federal3
4034 Indian education programs. BIE-funded schools, including schools4
4135 receiving funding pursuant to 25 U.S.C. sec.1810 and tribally controlled5
4236 colleges and universities receiving funding pursuant to 25 U.S.C. sec.6
4337 1810, are forward funded; and7
4438 WHEREAS, Forward funding of the BIE will make grant program8
4539 funds available for obligation on July 1 of any given fiscal year, and the9
4640 funds will remain available until September 30 of the succeeding fiscal10
4741 year; and11
4842 WHEREAS, Congress may authorize forwarding funding and12
4943 make a one-time appropriation of such sums, as necessary, to forward13
5044 fund the BIE grant program; now, therefore,14
5145 Be It Resolved by the Senate of the Seventy-third General15
5246 Assembly of the State of Colorado:16
5347 That we, the members of the Colorado Senate strongly urge17
5448 Congress to forward fund the Bureau of Indian Education Higher18
5549 Education Grant Program as authorized by the federal "Act of November19
5650 2, 1921".20
5751 Be It Further Resolved, That copies of this Memorial be sent to the21
5852 Clerk of the United States House of Representatives; the Secretary of the22
5953 United States Senate; each member of Colorado's congressional23
60-delegation; Melvin Baker, Chairman of the Southern Ute Indian Tribe;24
