WHEREAS, The Bureau of Indian Education (BIE) operates the1
Higher Education Grant Program (grant program) as authorized by the2
federal "Act of November 2, 1921", commonly referred to as the "Snyder3
Act", 25 U.S.C. sec. 13; and4
WHEREAS, Numerous Indian tribal governments provide college5
financial assistance and scholarships from the grant program directly to6
Indian college students through the federal "1975 Indian7
Self-determination and Education Assistance Act", Pub.L. 93-638, or8
through the federal "Tribal Self-governance Act of 1994", Pub.L.9
103-413; and10
WHEREAS, The federal government routinely operates under11
continuing resolutions. As such, grant program funding is delayed;12
consequently, college scholarship and financial assistance payments and13
institutional disbursements are delayed, which is problematic for many14

books, room, and board; and2
WHEREAS, There is precedent for forward funding of federal3
Indian education programs. BIE-funded schools, including schools4
receiving funding pursuant to 25 U.S.C. sec.1810 and tribally controlled5
colleges and universities receiving funding pursuant to 25 U.S.C. sec.6
1810, are forward funded; and7
WHEREAS, Forward funding of the BIE will make grant program8
funds available for obligation on July 1 of any given fiscal year, and the9
funds will remain available until September 30 of the succeeding fiscal10
year; and11
WHEREAS, Congress may authorize forwarding funding and12
make a one-time appropriation of such sums, as necessary, to forward13
fund the BIE grant program; now, therefore,14
Be It Resolved by the Senate of the Seventy-third General15
Assembly of the State of Colorado:16
That we, the members of the Colorado Senate strongly urge17
Congress to forward fund the Bureau of Indian Education Higher18
Education Grant Program as authorized by the federal "Act of November19
2, 1921".20
Be It Further Resolved, That copies of this Memorial be sent to the21
Clerk of the United States House of Representatives; the Secretary of the22
United States Senate; each member of Colorado's congressional23
delegation; Melvin Baker, Chairman of the Southern Ute Indian Tribe;24
Manuel Heart, Chairman of the Ute Mountain Ute Tribe; and Jonathan25
Nez, President of the Navajo Nation.26
