15-Be it enacted by the General Assembly of the State of Colorado:
16-SECTION 1. In Colorado Revised Statutes, 42-3-107, amend
17-(16)(d)(III), (16)(g)(I)(A), (16)(g)(I)(C), (16)(g)(I)(D),
18-AND (16)(g)(III); and
19-add (16)(g)(I)(E) and (16)(g)(V) as follows:
20-42-3-107. Taxable value of classes of property - rate of tax -
21-when and where payable - department duties - apportionment of tax
22-collections - definitions - rules - repeal. (16) (d) (III) The department
23-shall allow the owner to file the report electronically with the department
24-of revenue either by electronic transmission or by electronically readable

44-(16) (g) (I) An owner of special mobile machinery who pays specific
45-ownership taxes in accordance with this subsection (16) may apply to the
46-department for a registration exempt certificate, which the department shall
47-issue to the owner if:
48-(A) The department verifies that the owner regularly has one
49-thousand or more items of such AT LEAST TWO HUNDRED FIFTY ITEMS OF
50-special mobile machinery in the state;
51-(C) Each item of such special mobile machinery bears a visible and
52-readily identifiable unique identification number assigned by the owner; and
53-(D) Each item of such special mobile machinery bears a visible
54-toll-free telephone number for the owner that can be used for verification
55-of ownership;
56-AND
57-(E) THE OWNER OF THE SPECIAL MOBILE MACHINERY HAS PAID ALL
58-FEES AND SURCHARGES REFERENCED IN THIS SECTION
59-.
60-(III) An item of special mobile machinery that is owned by a person
61-to whom the department has issued a registration exempt certificate is not
62-required to be registered, and the department shall not require the owner of
63-any such item of
64-THE special mobile machinery to obtain license plates,
65-annual validating tabs, or identifying decals for the item of special mobile
66-machinery. Notwithstanding the exemptions from registration and licensing
67-requirements for any such item of special mobile machinery, at the time
68-during each calendar year in which specific ownership tax is first paid for

81-validating tabs or any fee that would otherwise be retained by an authorized
82-agent for the purpose of defraying the direct costs incurred by the
83-authorized agent in registering or issuing license plates, decals, or validating
84-tabs for the item. The department shall transmit all additional registration
85-fees imposed pursuant to section 42-3-310 that it receives from owners of
86-special mobile machinery to whom the department has issued a registration
87-exempt certificate to the county treasurer of each county of the state in
88-proportion to the total amount of vehicle registrations statewide represented
89-by vehicle registrations within the county, and each county treasurer shall
90-apportion the fees within the county in the manner specified in section
91-42-3-310.

174-SECTION 2. Appropriation. (1) For the 2023-24 state fiscal year,
175-$113,476 is appropriated to the department of revenue for use by the
176-division of motor vehicles. This appropriation is from Colorado DRIVES
177-vehicle services account in the highway users tax fund created in section
178-42-1-211 (2), C.R.S. To implement this act, the division may use this
179-appropriation as follows:
180-(a) $47,492 for personal services related to vehicle services, which
181-PAGE 4-SENATE BILL 23-049 amount is based on an assumption that the division will require an
182-additional 0.8 FTE;
183-(b) $12,962 for operating expenses related to vehicle services; and
184-(c) $53,022 for DRIVES maintenance and support.
185-SECTION 3. Act subject to petition - effective date. This act
186-takes effect at 12:01 a.m. on the day following the expiration of the
187-ninety-day period after final adjournment of the general assembly; except
188-that, if a referendum petition is filed pursuant to section 1 (3) of article V
189-of the state constitution against this act or an item, section, or part of this act
190-within such period, then the act, item, section, or part will not take effect
191-unless approved by the people at the general election to be held in
192-PAGE 5-SENATE BILL 23-049 November 2024 and, in such case, will take effect on the date of the official
193-declaration of the vote thereon by the governor.

53+Be it enacted by the General Assembly of the State of Colorado:1

182+(a) $47,492 for personal services related to vehicle services,20
183+which amount is based on an assumption that the division will require an21
184+additional 0.8 FTE;22
185+(b) $12,962 for operating expenses related to vehicle services; and23
186+(c) $53,022 for DRIVES maintenance and support.24
187+SECTION 3. Act subject to petition - effective date. This act25
188+takes effect at 12:01 a.m. on the day following the expiration of the26
189+ninety-day period after final adjournment of the general assembly; except27

191+-6- that, if a referendum petition is filed pursuant to section 1 (3) of article V1
192+of the state constitution against this act or an item, section, or part of this2
193+act within such period, then the act, item, section, or part will not take3
194+effect unless approved by the people at the general election to be held in4
195+November 2024 and, in such case, will take effect on the date of the5
196+official declaration of the vote thereon by the governor.6
