7-ONCERNING THE AUTHORITY OF HISTORY COLORADO TO DISPOSE OF ITS

11-Be it enacted by the General Assembly of the State of Colorado:
12-SECTION 1. Legislative declaration. (1) The general assembly
13-finds and declares that:
14-(a) In 2011, the state historical society, also known as history
15-Colorado, acquired property that is referred to as the north storage facility
16-(facility), which is the current collections storage facility and the state
17-historical fund document repository. Initially, history Colorado intended to
18-use the facility for temporary storage of large items in the collection while
19-the history Colorado center was built, but it became clear that the storage
20-space was still needed to house the collection and the facility was switched
21-to permanent storage.
22-NOTE: This bill has been prepared for the signatures of the appropriate legislative
23-officers and the Governor. To determine whether the Governor has signed the bill
24-or taken other action on it, please consult the legislative status sheet, the legislative
25-history, or the Session Laws.

29-the act. (b) The collection has continued to grow and there are currently
30-85,000 square feet of artifacts, which is more square footage than the
31-facility adequately provides, making it too small to meet the storage and
32-care needs of history Colorado. Additionally, issues with the different
33-building systems, including electrical, mechanical, and fire suppression,
34-make it difficult to maintain an optimal care environment for the collection.
35-(c) History Colorado has determined that, due to these challenges,
36-the facility is no longer a suitable facility for the consolidated collections,
37-care, and storage necessary to house significant artifacts that history
38-Colorado is statutorily responsible for collecting and preserving on the
39-state's behalf. The disposition of the property will be in the best interest of
40-the organization and allow history Colorado to lease a more suitable facility
41-for ongoing storage and care of the collection and to provide current and
42-future controlled maintenance needs of all of history Colorado's community
43-and historic sites.
44-SECTION 2. History Colorado authority to dispose of real
45-property. (1) The state, acting by and through the state historical society,
46-also known as history Colorado, is authorized to dispose of real property
47-located at 1100 W. 47th Ave., Denver, Colorado 80211, lots 13 to 36
48-inclusive & vacated alley interjacent thereto block 13 Richards subdivision
49-& NLY 8 1/2 feet of vacated Alice Place adjacent to 25 through 36 in SD
50-block, City and County of Denver, state of Colorado.
51-(2) The capital development committee and the state controller must
52-approve all agreements relating to the disposition of the real property
53-described in subsection (1) of this section prior to closing.
54-(3) History Colorado shall credit the proceeds of the disposition of
55-the real property described in subsection (1) of this section to the state
56-museum cash fund created in section 24-80-214, Colorado Revised Statutes,
57-to be used for moving, retrofitting, lease-related, and acquisition costs for
58-a new storage facility that history Colorado will lease in the future or for
59-controlled maintenance.
60-SECTION 3. Act subject to petition - effective date. This act
61-takes effect at 12:01 a.m. on the day following the expiration of the
62-ninety-day period after final adjournment of the general assembly; except
63-that, if a referendum petition is filed pursuant to section 1 (3) of article V
64-PAGE 2-SENATE BILL 24-177 of the state constitution against this act or an item, section, or part of this act
65-within such period, then the act, item, section, or part will not take effect
66-unless approved by the people at the general election to be held in
67-November 2024 and, in such case, will take effect on the date of the official
68-declaration of the vote thereon by the governor.
