C ONCERNING THE AUTHORITY OF HISTORY COLORADO TO DISPOSE OF ITS NORTH STORAGE FACILITY . Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Legislative declaration. (1) The general assembly finds and declares that: (a) In 2011, the state historical society, also known as history Colorado, acquired property that is referred to as the north storage facility (facility), which is the current collections storage facility and the state historical fund document repository. Initially, history Colorado intended to use the facility for temporary storage of large items in the collection while the history Colorado center was built, but it became clear that the storage space was still needed to house the collection and the facility was switched to permanent storage. NOTE: This bill has been prepared for the signatures of the appropriate legislative officers and the Governor. (b) The collection has continued to grow and there are currently 85,000 square feet of artifacts, which is more square footage than the facility adequately provides, making it too small to meet the storage and care needs of history Colorado. Additionally, issues with the different building systems, including electrical, mechanical, and fire suppression, make it difficult to maintain an optimal care environment for the collection. (c) History Colorado has determined that, due to these challenges, the facility is no longer a suitable facility for the consolidated collections, care, and storage necessary to house significant artifacts that history Colorado is statutorily responsible for collecting and preserving on the state's behalf. The disposition of the property will be in the best interest of the organization and allow history Colorado to lease a more suitable facility for ongoing storage and care of the collection and to provide current and future controlled maintenance needs of all of history Colorado's community and historic sites. SECTION 2. History Colorado authority to dispose of real property. (1) The state, acting by and through the state historical society, also known as history Colorado, is authorized to dispose of real property located at 1100 W. 47th Ave., Denver, Colorado 80211, lots 13 to 36 inclusive & vacated alley interjacent thereto block 13 Richards subdivision & NLY 8 1/2 feet of vacated Alice Place adjacent to 25 through 36 in SD block, City and County of Denver, state of Colorado. (2) The capital development committee and the state controller must approve all agreements relating to the disposition of the real property described in subsection (1) of this section prior to closing. (3) History Colorado shall credit the proceeds of the disposition of the real property described in subsection (1) of this section to the state museum cash fund created in section 24-80-214, Colorado Revised Statutes, to be used for moving, retrofitting, lease-related, and acquisition costs for a new storage facility that history Colorado will lease in the future or for controlled maintenance. SECTION 3. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly; except that, if a referendum petition is filed pursuant to section 1 (3) of article V PAGE 2-SENATE BILL 24-177 of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2024 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. ____________________________ ____________________________ Steve Fenberg Julie McCluskie PRESIDENT OF SPEAKER OF THE HOUSE THE SENATE OF REPRESENTATIVES ____________________________ ____________________________ Cindi L.
