General Assembly Substitute Bill No. 1189 January Session, 2011 *_____SB01189GAE___033111____* General Assembly Substitute Bill No. 1189 January Session, 2011 *_____SB01189GAE___033111____* AN ACT CONCERNING STATE CONTRACTING AND A DISPARITY STUDY. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (Effective from passage) (a) The Commissioner of Administrative Services shall, within available appropriations and in consultation with the Commission on Human Rights and Opportunities, conduct a disparity study. The study shall generate statistical data concerning the state's current set-aside program, established under section 4a-60g of the general statutes, to determine whether its current form achieves the goal of facilitating the participation in state contracts of small contractors and businesses owned by a minority or an individual with a disability. The study shall include, but not be limited to, examining: (1) Whether there is significant evidence of past or continuing discrimination in the way that the state's contracting duties are executed; (2) The number of small contractors or businesses owned by a minority or an individual with a disability that are qualified for eligibility for state contracts and a determination of whether such businesses are legitimately owned by a minority or an individual with a disability; and (3) The state's contracting processes to determine if there are any unintentional but existing barriers in the process that prevent small contractors and businesses owned by a minority or an individual with a disability from fully participating in the state's contracting process. (b) Not later than January 1, 2012, the Commissioner of Administrative Services shall submit the commissioner's findings concerning such study and any recommendations for legislative action concerning such study, in accordance with the provisions of section 11-4a of the general statutes, to the joint standing committee of the General Assembly having cognizance of matters relating to government administration.
