20+POLYFLUOROALKYL SUBS TANCES IN CERTAIN PRODUCTS.
1721 Be it enacted by the Senate and House of Representatives in General
1822 Assembly convened:

20-Section 1. (NEW) (Effective July 1, 2019) (a) As used in this section: 1
21-(1) "Perfluoroalkyl or polyfluoroalkyl substance" means a class of 2
22-fluorinated organic chemicals containing at least one fully fluorinated 3
23-carbon atom; 4
24-(2) "Class B firefighting foam" means a foam used for the purpose of 5
25-extinguishing flammable liquid fires; and 6
26-(3) "Testing" includes calibration testing, conformance testing and 7
27-fixed system testing as required by state or municipal law or policy. 8
28-(b) On and after July 1, 2020, no person, local government or state 9
29-agency may use a class B firefighting foam that contains an 10
30-intentionally added perfluoroalkyl or polyfluoroalkyl substance in any 11
31-amount (1) for training purposes, or (2) for testing purposes unless the 12
32-person, local government or state agency has implemented 13
33-containment, treatment and disposal measures at the testing facility to 14
34-prevent the release of such foam into the environment. 15
35-(c) On or after July 1, 2019, the Department of Public Health shall 16 Substitute Bill No. 5910

26+(1) "Perfluoroalkyl and polyfluoroalkyl substances" mean a class of 3
27+fluorinated organic chemicals containing at least one fully fluorinated 4
28+carbon atom; 5
29+(2) "Food packaging" means a material that is intended for direct 6
30+food contact and for single or limited use, including, but not limited to, 7
31+take-out containers and deli or bakery trays and wrappers; and 8
32+(3) "Reasonable alternative" means a product that has a similar use 9
33+and cost as the original product, but does not contain intentionally 10
34+added polyfluoroalkyl chemicals in any amount. 11
35+(b) The Department of Public Health shall examine the availability 12
36+of reasonable alternatives to any food packaging product that contains 13
37+an intentionally added perfluoroalkyl or polyfluoroalkyl substance. 14

42-assist any person, local government or state agency in evaluating and 17
43-transitioning to the use of class B firefighting foam that does not 18
44-contain an intentionally added perfluoroalkyl or polyfluoroalkyl 19
45-substance. 20
46-(d) The provisions of this section may be enforced, within available 21
47-appropriations, by the Commissioner of Consumer Protection. 22
43+Not later than January 1, 2020, the department shall report, in 15
44+accordance with the provisions of section 11-4a of the general statutes, 16
45+to the joint standing committee of the General Assembly having 17
46+cognizance of matters relating to public health on the results of such 18
47+examination and a list of food packaging products that contain an 19
48+intentionally added perfluoroalkyl or polyfluoroalkyl substance for 20
49+which a reasonable alternative is available. 21
50+(c) On and after January 1, 2021, no person may manufacture, 22
51+knowingly sell, offer for sale, distribute for sale or distribute for use in 23
52+the state food packaging that contains a perfluoroalkyl or 24
53+polyfluoroalkyl substance that was intentionally added to such 25
54+packaging in any amount when the department has determined, 26
55+pursuant to subsection (b) of this section, that a reasonable alternative 27
56+to such food packaging is available. 28
57+(d) The provisions of this section may be enforced, within available 29
58+appropriations, by the Commissioner of Consumer Protection. 30
59+Sec. 2. (NEW) (Effective July 1, 2019) (a) As used in this section, "class 31
60+B firefighting foam" means a foam for the purpose of extinguishing 32
61+flammable liquid fires. 33
62+(b) The Department of Public Health shall examine the availability 34
63+of reasonable alternatives to any class B firefighting foam that contains 35
64+an intentionally added perfluoroalkyl or polyfluoroalkyl substance. 36
65+Not later than January 1, 2020, the department shall report, in 37
66+accordance with the provisions of section 11-4a of the general statutes, 38
67+to the joint standing committee of the General Assembly having 39
68+cognizance of matters relating to public health on the results of such 40
69+examination. 41
70+(c) On and after July 1, 2020, (1) no person, local government or state 42
71+agency may discharge or otherwise use for training purposes a class B 43
72+firefighting foam that contains an intentionally added perfluoroalkyl 44
73+or polyfluoroalkyl substance in any amount, and (2) a manufacturer of 45

79+a class B firefighting foam may not manufacture, knowingly sell, offer 46
80+for sale, distribute for sale or distribute for use in the state a class B 47
81+firefighting foam that contains an intentionally added perfluoroalkyl 48
82+or polyfluoroalkyl substance in any amount, unless the addition of a 49
83+perfluoroalkyl or polyfluoroalkyl substance is necessary for the 50
84+purpose of complying with federal law, including, but not limited to, 51
85+the requirements set forth in 14 CFR 139.317, as amended from time to 52
86+time. 53
87+(d) The provisions of this section may be enforced, within available 54
88+appropriations, by the Commissioner of Consumer Protection. 55
