Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective July 1, 2019) (a) As used in this section: 1 (1) "Perfluoroalkyl or polyfluoroalkyl substance" means a class of 2 fluorinated organic chemicals containing at least one fully fluorinated 3 carbon atom; 4 (2) "Class B firefighting foam" means a foam used for the purpose of 5 extinguishing flammable liquid fires; and 6 (3) "Testing" includes calibration testing, conformance testing and 7 fixed system testing as required by state or municipal law or policy. 8 (b) On and after July 1, 2020, no person, local government or state 9 agency may use a class B firefighting foam that contains an 10 intentionally added perfluoroalkyl or polyfluoroalkyl substance in any 11 amount (1) for training purposes, or (2) for testing purposes unless the 12 person, local government or state agency has implemented 13 containment, treatment and disposal measures at the testing facility to 14 prevent the release of such foam into the environment. 15 (c) On or after July 1, 2019, the Department of Public Health shall 16 Substitute Bill No. 5910 LCO {\\PRDFS1\HCOUSERS\BARRYJN\WS\2019HB-05910- R02-HB.docx } 2 of 2 assist any person, local government or state agency in evaluating and 17 transitioning to the use of class B firefighting foam that does not 18 contain an intentionally added perfluoroalkyl or polyfluoroalkyl 19 substance. 20 (d) The provisions of this section may be enforced, within available 21 appropriations, by the Commissioner of Consumer Protection. 22 This act shall take effect as follows and shall amend the following sections: Section 1 July 1, 2019 New section PH Joint Favorable Subst.
