19	19	AN ACT CONCERNING DE NTAL AND VISION INSURANCE
20	20	COVERAGE FOR CHILDRE N, STEPCHILDREN AND OTH ER
21	21	DEPENDENT CHILDREN.
22	22	Be it enacted by the Senate and House of Representatives in General
23	23	Assembly convened:

25	25	Section 1. Section 38a-497 of the general statutes is repealed and the 1
26	26	following is substituted in lieu thereof (Effective January 1, 2021): 2
27	27	(a) Each individual health insurance policy providing coverage of the 3
28	28	type specified in subdivisions (1), (2), (4), (6), (10), (11) and (12) of section 4
29	29	38a-469 delivered, issued for delivery, amended, renewed or continued 5
30	30	in this state shall provide that coverage of a child, stepchild or other 6
31	31	dependent child shall terminate [no] not earlier than the policy 7
32	32	anniversary date on or after whichever of the following occurs first, the 8
33	33	date on which the child, [:] stepchild or other dependent child: (1) 9
34	34	Becomes covered under a group health plan through the [dependent's] 10
35	35	child's, stepchild's or other dependent child's own employment; or (2) 11
36	36	attains the age of twenty-six. 12
37	37	(b) Each individual health insurance policy described in subsection 13
38	38	(a) of this section, and each individual health insurance policy providing 14

45	45	coverage of the type specified in subdivision (16) of section 38a-469 15
46	46	delivered, issued for delivery, amended, renewed or continued in this 16
47	47	state, that includes or provides dental or vision coverage shall provide 17
48	48	that dental or vision coverage of a child, stepchild or other dependent 18
49	49	child shall terminate not earlier than the policy anniversary date on or 19
50	50	after whichever of the following occurs first, the date on which the child, 20
51	51	stepchild or other dependent child: (1) Becomes covered under a group 21
52	52	health plan through the child's, stepchild's or other dependent child's 22
53	53	own employment; or (2) attains the age of twenty-six. 23
54	54	(c) Each [such] policy subject to this section shall cover a stepchild or 24
55	55	other dependent child on the same basis as a biological child. 25
56	56	Sec. 2. Section 38a-512b of the general statutes is repealed and the 26
57	57	following is substituted in lieu thereof (Effective January 1, 2021): 27
58	58	(a) Each group health insurance policy providing coverage of the type 28
59	59	specified in subdivisions (1), (2), (4), (6), (10), (11) and (12) of section 38a-29
60	60	469 delivered, issued for delivery, amended, renewed or continued in 30
61	61	this state shall provide that coverage of a child, stepchild or other 31
62	62	dependent child shall terminate [no] not earlier than the policy 32
63	63	anniversary date on or after whichever of the following occurs first, the 33
64	64	date on which the child, [:] stepchild or other dependent child: (1) 34
65	65	Becomes covered under a group health plan through the [dependent's] 35
66	66	child's, stepchild's or other dependent child's own employment; or (2) 36
67	67	attains the age of twenty-six. 37
68	68	(b) Each group health insurance policy described in subsection (a) of 38
69	69	this section, and each group health insurance policy providing coverage 39
70	70	of the type specified in subdivision (16) of section 38a-469 delivered, 40
71	71	issued for delivery, amended, renewed or continued in this state, that 41
72	72	includes or provides dental or vision coverage shall provide that dental 42
73	73	or vision coverage of a child, stepchild or other dependent child shall 43
74	74	terminate not earlier than the policy anniversary date on or after 44
75	75	whichever of the following occurs first, the date on which the child, 45

94	94	To allow children, stepchildren and other dependent children to retain
95	95	dental and vision insurance coverage under their parents' insurance
96	96	policies until they attain the age of twenty-six or obtain substitute
97	97	coverage through an employer.
