912 AN ACT CONCERNING A DISPARITY STUDY.
1013 Be it enacted by the Senate and House of Representatives in General
1114 Assembly convened:

13-Section 1. (Effective from passage) (a) Not later than ninety days after
14-the effective date of this section, the Commission on Human Rights and
15-Opportunities shall, in consultation with the Department of
16-Administrative Services, develop and issue a request for proposals for
17-the conducting of a disparity study. The commission shall, in
18-consultation with such department, develop criteria for evaluating
19-proposals relating to conducting a disparity study, including, but not
20-limited to: (1) The anticipated cost of completing such a study, (2) the
21-anticipated timeline for completing such a study, and (3) the proposing
22-firm's experience in conducting and completing such a study. The
23-deadline for responding to the request for proposals shall be not later
24-than sixty days from the issuing of the request by the commission.
25-(b) Not later than January 1, 2022, the commission, in consultation
26-with the department, shall evaluate the proposals submitted under
27-subsection (a) of this section and select the firm which shall conduct the
28-study.
29-(c) The study shall provide an analysis of existing statistical data
30-concerning the state's set-aside program, established under section 4a- Substitute House Bill No. 6476

35-achieves the goal of facilitating the participation in state contracts of
36-small contractors and minority business enterprises. The study shall
37-include, but shall not be limited to, a review of the state's current set-
38-aside program practices and the best practices of other states or
39-governmental entities. The study shall examine:
40-(1) Whether, based on available data and analysis, there is significant
41-statistical evidence of past or continuing discrimination in the awarding
42-of state contracts;
43-(2) The number of small contractors or minority business enterprises,
44-based on available data and analysis, that are qualified for eligibility for
45-state contracts under the set-aside program established under section
46-4a-60g of the general statutes, and a determination of whether such
47-businesses are legitimate small contractors or legitimately owned by
48-members of a minority; and
49-(3) The state's contracting processes, to determine if there are any
50-contracting practices or unintentional but existing barriers in the process
51-that prevent small contractors and minority business enterprises from
52-fully participating in such contracting process.
53-(d) The executive director of the Commission on Human Rights and
54-Opportunities shall submit the findings of such study and any
55-recommendations for legislative action concerning such study, in
56-accordance with the provisions of section 11-4a of the general statutes,
57-to the joint standing committees of the General Assembly having
58-cognizance of matters relating to government administration and labor.
