920 AN ACT CONCERNING EL ECTRONIC DELIVERY TICKETS FOR
1021 GASOLINE, KEROSENE, FUEL OILS OR SIMILAR SUBSTANCES.
1122 Be it enacted by the Senate and House of Representatives in General

14-Section 1. Subsection (a) of section 14-329 of the general statutes is
15-repealed and the following is substituted in lieu thereof (Effective October
16-1, 2021):
17-(a) (1) The standard gallon shall be the unit of measurement for all
18-sales of gasoline, kerosene, fuel oils or similar substances sold or offered
19-for sale for the purpose of creating power or heat. Each delivery of
20-gasoline in a quantity of fifty gallons or more and each delivery of
21-kerosene, fuel oil or similar substance in a quantity of five gallons or
22-more shall be the complete contents of a vehicle tank or it shall be
23-through a meter. Each such tank or meter shall be sealed by a sealer of
24-weights and measures before being used. The term "vehicle tank", as
25-used [herein] in this section, means a container, which may or may not
26-be subdivided into two or more compartments, mounted upon a wagon
27-or motor truck and used for the delivery of such fluids. The term
28-"compartment" means the entire tank whenever the tank is not
29-subdivided; otherwise it means any one of those subdivided portions of
30-the tank which are designed to hold such fluids. Each delivery through
31-a meter shall be delivered through a meter equipped with a numeral Senate Bill No. 152

31+gasoline in a quantity of fifty gallons or more and each delivery of 7
32+kerosene, fuel oil or similar substance in a quantity of five gallons or 8
33+more shall be the complete contents of a vehicle tank or it shall be 9
34+through a meter. Each such tank or meter shall be sealed by a sealer of 10
35+weights and measures before being used. The term "vehicle tank", as 11
36+used [herein] in this section, means a container, which may or may not 12
37+be subdivided into two or more compartments, mounted upon a wagon 13
38+or motor truck and used for the delivery of such fluids. The term 14

35-reset counter, a register with a zero start or an accumulative ticket
36-printer, which meters shall print an accurate record of all deliveries in
37-gallons and tenths. Such ticket printer shall print the gallonage reading
38-of the meter before and after delivery is made and each ticket shall be
39-locked in the meter between readings [so as] to prevent fraud. [Each]
40-Except as provided in subdivision (2) of this subsection, each delivery
41-shall be accompanied by a delivery ticket and a duplicate thereof, on
42-which shall be distinctly expressed in ink or other indelible substance,
43-in gallons, or gallons and tenths when so required, the quantity of such
44-fluid so delivered, with the name of the seller and the name of the
45-purchaser of such fluid.
46-(2) A seller may provide an electronic version of a delivery ticket
47-instead of a delivery ticket expressed in ink or other indelible substance,
48-if the seller or agent of such seller and the purchaser of a fluid, described
49-in subdivision (1) of this subsection, agree to such electronic delivery, in
50-writing. The seller shall retain a record of each electronic delivery ticket
51-for not less than twelve months.
52-(3) One of such delivery or electronic delivery tickets shall be
53-surrendered, upon demand, to the sealer of weights and measures, for
54-[his] inspection, and such ticket or, when the sealer desires to retain the
55-original ticket or electronic ticket, a measure slip issued by the seller or
56-his or her agent, shall be delivered to the purchaser or [his] purchaser's
57-agent or representative at the time of the delivery of such fluid. If the
58-purchaser or [his] purchaser's agent takes such fluid from the place of
59-purchase, a delivery ticket showing the actual number of gallons, or
60-gallons and tenths, delivered shall be given to the purchaser or [his]
61-purchaser's agent at the time of delivery. In the case of an electronic
62-delivery ticket, the seller or agent of such seller shall transmit the
63-electronic delivery ticket to the purchaser or purchaser's agent not more
64-than two business days after such delivery. Delivery tickets shall bear
65-the name or identification number of the seller's driver and shall be Senate Bill No. 152

78+the seller for one year and shall be available for inspection during 48 Committee Bill No. 152

70-the seller for one year and shall be available for inspection during
71-normal business hours. No seller, or agent of such seller, shall possess a
72-delivery ticket which has been printed with, or an electronic delivery
73-ticket which contains, a record of a delivery which has not occurred. The
74-method of determining the number of gallons of any such fluid
75-delivered shall be by measuring the same in measures that have been
76-tested and sealed by a sealer of weights and measures.
