15+COUNCILS.
1116 Be it enacted by the Senate and House of Representatives in General

14-Section 1. (NEW) (Effective from passage) (a) For purposes of this
15-section, (1) "residents council" means a council elected and run by
16-residents of a long-term care facility that brings concerns to
17-management of such facility about residents' living conditions and care,
18-(2) "family council" means a council comprised of family members of
19-residents of long-term care facilities that brings concerns to
20-management of such facility about residents' living conditions and care,
21-and (3) "long-term care facility" means a nursing home facility, as
22-defined in section 19a-490 of the general statutes, or a managed
23-residential community, as defined in section 19a-693 of the general
24-statutes, with assisted living services regulated by the Department of
25-Public Health.
26-(b) Not later than three days after a state agency submits a legislative
27-proposal to the General Assembly or posts a notice of intent on the
28-eRegulations System proposing a new or revised regulation concerning
29-living and care conditions at long-term care facilities, such agency shall
30-inform the State Ombudsman, appointed pursuant to section 17a-405 of
31-the general statutes, and the executive director of the Commission on Substitute Senate Bill No. 973

31+(b) Not later than seven days after introduction of any state-wide 13
32+policy, legislative proposal or regulation concerning living and care 14
33+conditions at long-term care facilities by any state agency or legislative 15
34+committee having cognizance of matters concerning such policy, 16
35+proposal or regulation, such agency or legislative committee shall 17
36+inform the State Ombudsman, appointed pursuant to section 17a-405 of 18 Substitute Bill No. 973

35-Women, Children, Seniors, Equity and Opportunity, established
36-pursuant to section 2-127 of the general statutes. The State Ombudsman
37-and the executive director shall seek testimony from the Statewide
38-Coalition of Presidents of Residents Councils and from family councils
39-concerning such legislative proposal or proposed regulation. For
40-regulations other than those proposed pursuant to subsections (g) and
41-(h) of section 4-168 of the general statutes, the State Ombudsman and
42-the executive director shall immediately inform the members of the
43-coalition and family councils that the agency will be required to hold a
44-public hearing upon the request of fifteen or more persons not later than
45-fourteen days after the date such notice of intent is posted on the
46-eRegulations System. Such agency or legislative committee of
47-cognizance shall accept testimony in a manner and format that provides
48-for the greatest input from members of residents councils and family
49-councils including, but not limited to, when permissible under the rules
50-of such agency or committee and when practicable, remote testimony
51-by such members via technology with audio or audio and video
52-capabilities.
53-(c) Any state task force appointed by the General Assembly or by a
54-state agency that is studying issues concerning living or care conditions
55-at long-term care facilities shall include among members (1)
56-representatives of residents councils, (2) representatives of family
57-councils, and (3) the chairpersons and ranking members of the joint
58-standing committee of the General Assembly having cognizance of
59-matters relating to aging, or their designees. The chairpersons of such
60-task force shall schedule meetings in a manner and format that provides
61-for the greatest input from members of residents councils and family
62-councils, including, but not limited to, when practicable, remote
63-testimony by such members via technology with audio or video
64-capabilities.
