914 AN ACT AMENDING A CO NVEYANCE OF A PARCEL OF STATE
1015 LAND IN THE TOWN OF FAIRFIELD.
1116 Be it enacted by the Senate and House of Representatives in General
1217 Assembly convened:

14-Section 1. Section 23 of special act 01-6 is amended to read as follows
15-(Effective from passage):
16-(a) Notwithstanding any provision of the general statutes, the
17-Commissioner of Transportation shall convey to the town of Fairfield a
18-parcel of land located in the town of Fairfield, at a cost equal to the
19-administrative costs of making such conveyance. Said parcel of land has
20-an area of approximately [1.3 acres] .3 acre and is identified as 488 [-512]
21-Tunxis Hill Road. The conveyance shall be subject to the approval of the
22-State Properties Review Board.
23-(b) The town of Fairfield shall use, lease or sell said parcel of land for
24-a public works garage, economic development or housing purposes. If
25-the town of Fairfield [:
26-(1) Does not use said parcel for said purposes;
27-(2) Does not retain ownership of all of said parcel; or
28-(3) Leases all or any portion of said parcel] does not use, lease or sell Substitute Senate Bill No. 1111

26+Road. The conveyance shall be subject to the approval of the State 8

28+(b) The town of Fairfield shall use said parcel of land for [a public 10

32-said parcel for any of said purposes within five years after the effective
33-date of this section, the parcel shall revert to the state of Connecticut.
34-Any sale of said parcel by the town of Fairfield shall be made at a cost
35-equal to the fair market value of said parcel, as determined by the
36-average of the appraisals of two independent appraisers selected by the
37-commissioner. Such appraisals shall be completed not later than six
38-months after the conveyance to the town under this section and shall be
39-updated thereafter as necessary. The net proceeds of such sale after
40-closing costs received by the town of Fairfield from a sale in accordance
41-with this subsection shall be transferred to the State Treasurer for
42-deposit in the Special Transportation Fund.
43-(c) The State Properties Review Board shall complete its review of the
44-conveyance of said parcel of land not later than thirty days after it
45-receives a proposed agreement from the Department of Transportation.
46-The land shall remain under the care and control of said department
47-until a conveyance is made in accordance with the provisions of this
48-section. The State Treasurer shall execute and deliver any deed or
49-instrument necessary for a conveyance under this section, which deed
50-or instrument shall include provisions to carry out the purposes of
51-subsection (b) of this section. The Commissioner of Transportation shall
52-have the sole responsibility for all other incidents of such conveyance.

41+the effective date of this section, the parcel shall revert to the state of 17
42+Connecticut. If the town of Fairfield sells said parcel of land for economic 18
43+development or housing purposes, the town of Fairfield shall pay the 19
44+proceeds from the sale to the State Treasurer, who shall deposit said 20
45+proceeds in the Special Transportation Fund established in section 13b-68 21
46+of the general statutes. 22
47+(c) The State Properties Review Board shall complete its review of the 23
48+conveyance of said parcel of land not later than thirty days after it 24
49+receives a proposed agreement from the Department of Transportation. 25
