22- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-act may be cited as the “Contract No. GAGA-2022-C-0142 with Maxim Healthcare Staffing
24-Services, Inc. Approval and Payment Authorization Emergency Act of 2023”.

26-Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved
27-December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and notwithstanding the
28-requirements of section 202 of the Procurement Practices Reform Act of 2010, effective April 8,
29-2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), the Council approves Contract No.
30-GAGA-2022-C-0142 with Maxim Healthcare Staffing Services, Inc., and Modification Nos. 1, 3,
31-4, 5, 6, and 7 thereto, to provide temporary healthcare staffing support to District of Columbia
32-Public Schools, and authorizes payment in the not-to-exceed amount of $4,057,912 for the goods
33-and services received from June 27, 2022 through September 30, 2022, and authorizes payment
34-in the not-to-exceed amount of $12,439,784 for goods and services received and to be received
35-during the period from October 1, 2022 through September 30, 2023.

37- Sec. 3. Fiscal impact statement.
38-The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal
39-impact statement required by section 4a of the General Legislative Procedures Act of 1975,
40-approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

43-This act shall take effect following approval by the Mayor (or in the event of veto by the

153+The contractor shall provide to District of Columbia Public Schools (DCPS) a spectrum of
154+temporary health care staffing support related to the COVID-19 crisis. The contractor will provide
155+critical services and support to ensure continuity of operations, continued pandemic recovery, and
156+ongoing learning for DCPS students.
157+The services will be provided to and managed by DCPS throughout all DCPS campuses serving
158+students K-12 students, as well as Central Services. The key functions required are:
159+• Health and safety screening for building entry;
160+• Operating and managing the Health Isolation Room;
161+• Centralized contact tracing and documentation for the purpose of minimizing spread and
162+reporting to local public health authorities;
163+• Providing technical assistance on COVID-19 policies, relevant protocols and District
164+guidance related to COVID-19;
165+• Administering and observing specimen collection for symptomatic and asymptomatic
166+testing when needed;
167+• Communicating directly with families;
168+• Other health related duties as deemed necessary by the school related to COVID-19 and
169+agreed upon by the School Leader and RN Supervisor; and
170+• Asymptomatic testing coordination.
171+On June 16,2022, the District of Columbia Public Schools (DCPS), Office of Contracts and
172+Acquisitions, issued Invitation for Bids (IFB) No. GAGA-2022-1-0142 in the open market, with a
173+35% certified business enterprise subcontracting requirement. Four bidders responded by the
174+closing date of June 22,2022. The contracting officer awarded the contract on June 27,2022 to
175+Maxim as the lowest-priced, responsive and responsible bidder.
176+Maxim is currently providing services to the satisfaction of DCPS under the current contract, which
177+expires on September 30, 2023. Maxim was established in 1988, in response to a national nursing
178+shortage to focus on the recruitment and staffing of quality healthcare professionals for a variety of
179+healthcare organizations. Maxim provides services to more than 6,500 clients nationwide,
180+including state, local and federal government agencies and departments, hospitals, correctional I

206+requirements. Likewise, Maxim maintains the financial resources, accounting, and operational
207+controls to fulfill DCPS’s requirements. Maxim has been deemed responsible in accordance with
208+DCPS’s standards for responsibility.

210+professionals across a variety of modalities and specialties, enabling DCPS to access the necessary
211+personnel resources to deliver services for its educational programs. Maxim currently partners with
212+several of the largest public-school districts in the US, including Los Angeles Unified School
213+District (CA), Clark County School District (NV), Houston Independent School District (TX),
214+Hillsborough County Public Schools (FL), Fairfax County Public Schools (VA), Gwinnett'County
215+Public Schools (GA) and Wake County Public Schools (NC).

236+There were multiple factors resulting in the awarding of the contract actions prior to submission to
237+the Council. The main factor was that DCPS experienced increased rates of vacancies and
238+turnovers in key staff, including the chief contracting officer position. This factor, along with the
239+decentralized administrative structure of DCPS’s contracting function, resulted in a failure to
240+request and obtain Council approval before the contract actions were implemented. DCPS regrets
241+this failure and is working to update and improve its processes and procedures and determine
242+appropriate administrative actions to be taken in response to the failure.
243+The contracting officer awarded the initial contract and continued with the exercise of option year
244+one so that the contractor could provide to DCPS a spectrum of temporary health care staffing
245+support related to the COVID-19 crisis. The services were necessary for all DCPS campuses
246+serving students K-12 students, as well as Central Services.
247+The contractor submitted a subcontracting plan in which the contractor committed to subcontracting
248+35% of the contract work to a District certified business enterprise.
249+The contractor shall provide qualified resources to perform the duties and tasks assigned by DCPS
250+according
251+ to the responsibilities outlined within the contract. The healthcare resources are expected
252+to report to their designated locations, perform the required duties, abide by District laws and
253+regulations, and comply with criminal background and suitability screening.
