61- Section 1. Section 111.095, Florida Statutes, is created 36

63- 111.095 Peer support for correctional officers and 38
64-correctional probation officers. 39
65- (1) As used in this section, the term: 40
66- (a) "Correctional officer" has the same meaning as in s. 41
67-943.10(2). 42
68- (b) "Correctional probation officer" has the same meaning 43
69-as in s. 943.10(3). 44
70- (c) "Part-time correctional officer" has the same meaning 45
71-as in s. 943.10(7). 46
72- (d) "Part-time correctional probation officer" has the 47
73-same meaning as in s. 943.10(19). 48
74- (e) "Peer support" means the provision of physical, moral, 49
75-or emotional support to a correctional officer or part -time 50
51+declaration of important state interest; providing an 26

54+Be It Enacted by the Legislature of the State of Florida: 29

56+ Section 1. Subsections (5) and (6) of section 112.1815, 31
57+Florida Statutes, are amended to read: 32
58+ 112.1815 Firefighters, paramedics, emergency medical 33
59+technicians, and law enforcement officers; special provisions 34
60+for employment-related accidents and injuries and posttraumatic 35
61+stress disorders. 36
62+ (5)(a) For the purposes of this section and chapter 440, 37
63+and notwithstanding sub -subparagraph (2)(a)3. and ss. 440.093 38
64+and 440.151(2), posttraumatic stress disorder, as described in 39
65+the Diagnostic and Statistical Manual of Mental Disorders, Fifth 40
66+Edition, published by the American Psychiatric Association, 41
67+suffered by a first responder is a compensable occupational 42
68+disease within the meaning of subsection (4) and s. 440.151 if: 43
69+ 1. The posttraumatic stress disorder resulted from the 44
70+first responder acting within the course of his or her 45
71+employment as provided in s. 440.091; and 46
72+ 2. The first responder is examined and subsequently 47
73+diagnosed with such disorder by a licensed psychiatrist who is 48
74+an authorized treating physician as provided in chapter 440 due 49
75+to one of the following events: 50

88-correctional officer or to a correctional probatio n officer or 51
89-part-time correctional probation officer for the purpose of 52
90-addressing physical or emotional conditions or other issues 53
91-associated with being a correctional officer or part -time 54
92-correctional officer or a correctional probation officer or 55
93-part-time correctional probation officer. 56
94- (f) "Peer support communication" means electronic, oral, 57
95-or written communication, made with a mutual expectation of 58
96-confidentiality while a peer support officer is providing peer 59
97-support in his or her official capaci ty. 60
98- (g) "Peer support officer" means a person who: 61
99- 1. Has experience working as or with a correctional 62
100-officer or a correctional probation officer regarding any 63
101-physical or emotional conditions or other issues associated with 64
102-the officer's employment. 65
103- 2. Has been designated by the employing agency to provide 66
104-peer support as provided in this section and has received 67
105-training for this purpose. 68
106- (2) A peer support officer may not divulge information 69
107-from or testify about a peer support communication in a civil, 70
108-criminal, administrative, or disciplinary proceeding, unless: 71
109- (a) The correctional officer or part -time correctional 72
110-officer peer or the correctional probation officer or part -time 73
111-correctional probation officer peer is a defendant in a civil, 74
112-criminal, administrative, or disciplinary proceeding arising 75
88+ a. Seeing for oneself a deceased minor; 51
89+ b. Directly witnessing the death of a minor; 52
90+ c. Directly witnessing an injury to a minor who 53
91+subsequently died before or upon arrival at a hospital emergency 54
92+department; 55
93+ d. Participating in the physical treatment of an injured 56
94+minor who subsequently died before or upon arrival at a hospital 57
95+emergency department; 58
96+ e. Manually transporting an injured minor who subsequently 59
97+died before or upon arrival at a hospital emergency department; 60
98+ f. Seeing for oneself a decedent whose death involved 61
99+grievous bodily harm of a nature that shocks the conscience; 62
100+ g. Directly witnessing a death, including suicide, that 63
101+involved grievous bodily harm of a nature that shocks the 64
102+conscience; 65
103+ h. Directly witnessing a homicide regardless of whether 66
104+the homicide was criminal or excusable, including murder, mass 67
105+killing as defined in 28 U.S.C. s. 530C, manslaughter, self -68
106+defense, misadventure, and negligence; 69
107+ i. Directly witnessing an injury, including an attempted 70
108+suicide, to a person who subsequently died before or upon 71
109+arrival at a hospital emergency department if the p erson was 72
110+injured by grievous bodily harm of a nature that shocks the 73
111+conscience; 74
112+ j. Participating in the physical treatment of an injury, 75

125-from a complaint filed by the peer support officer who was a 76
126-party to the peer support communication, in which case such 77
127-information may be divulged but is limited to the scope of the 78
128-proceeding; 79
129- (b) The correctional officer or part time correctional 80
130-officer or the correctional probation officer or part -time 81
131-correctional probation officer who was a party to the peer 82
132-support communication agrees, in writing, to allow the peer 83
133-support officer to testify about or divulge information related 84
134-to the peer support communica tion; 85
135- (c) Based on the peer support communication, the peer 86
136-support officer suspects that the correctional officer or part -87
137-time correctional officer or the correctional probation officer 88
138-or part-time correctional probation officer who was a party to 89
139-the peer support communication has committed a criminal act or 90
140-intends to commit a criminal act. There is no liability on the 91
141-part of, and no cause of action of any nature may arise against, 92
142-the peer support officer for disclosing information under this 93
143-paragraph; or 94
144- (d) There are articulable facts or circumstances that 95
145-would lead a reasonable, prudent person to fear for the safety 96
146-of the correctional officer or part -time correctional officer or 97
147-the correctional probation officer or part -time correctional 98
148-probation officer who was a party to the peer support 99
149-communication, another person, or society, and the peer support 100
125+including an attempted suicide, to a person who subsequently 76
126+died before or upon arrival at a hospital emergency de partment 77
127+if the person was injured by grievous bodily harm of a nature 78
128+that shocks the conscience; or 79
129+ k. Manually transporting a person who was injured, 80
130+including by attempted suicide, and subsequently died before or 81
131+upon arrival at a hospital emergency department if the person 82
132+was injured by grievous bodily harm of a nature that shocks the 83
133+conscience. 84
134+ (b) Such disorder must be demonstrated by clear and 85
135+convincing medical evidence. 86
136+ (c) Benefits for a first responder under this subsection: 87
137+ 1. Do not require a physical injury to the first 88
138+responder; and 89
139+ 2. Are not subject to: 90
140+ a. Apportionment due to a preexisting posttraumatic stress 91
141+disorder; 92
142+ b. Any limitation on temporary benefits under s. 440.093; 93
143+or 94
144+ c. The 1-percent limitation on permanent psychiatric 95
145+impairment benefits under s. 440.15(3). 96
146+ (d) The time for notice of injury or death in cases of 97
147+compensable posttraumatic stress disorder under this subsection 98
148+is the same as in s. 440.151(6) and is measured from one of the 99
149+qualifying events listed in subparagraph (a)2. or the 100

163-and law enforcement or other appropriate authorities. There is 102
164-no liability on the part of, and no cause of action of any 103
165-nature may arise against, the peer support officer for 104
166-disclosing information under this paragraph. 105
167- (3) This section does not limit the disclosure, discovery, 106
168-or admissibility of information, testimony, or evi dence that is 107
169-obtained by a peer support officer from a source other than a 108
170-correctional officer or part -time correctional officer or a 109
171-correctional probation officer or part -time correctional 110
172-probation officer through a peer support communication. 111
173- Section 2. Subsections (5) and (6) of section 112.1815, 112
174-Florida Statutes, are amended to read: 113
175- 112.1815 Firefighters, paramedics, emergency medical 114
176-technicians, and law enforcement officers; special provisions 115
177-for employment-related accidents and injuries. 116
178- (5)(a) For the purposes of this section and chapter 440, 117
179-and notwithstanding sub -subparagraph (2)(a)3. and ss. 440.093 118
180-and 440.151(2), posttraumatic stress disorder, as described in 119
181-the Diagnostic and Statistical Manual of Mental Disorders, Fifth 120
182-Edition, published by the American Psychiatric Association, 121
183-suffered by a first responder is a compensable occupational 122
184-disease within the meaning of subsection (4) and s. 440.151 if: 123
185- 1. The posttraumatic stress disorder resulted from the 124
186-first responder actin g within the course of his or her 125
162+manifestation of the disorder, whichever is later. A claim under 101
163+this subsection must be properly noticed within 52 weeks after 102
164+the qualifying event. 103
165+ (e) As used in this subsection, the term: 104
166+ 1. "Directly witnessing" means to see or hear for oneself. 105
167+ 2. "First responder" also includes a part -time law 106
168+enforcement officer as defined in s. 943.10(6) and an auxiliary 107
169+law enforcement officer as defined in s. 943.10(8). 108
170+ 3. "Manually transporting" means to perform physica l labor 109
171+to move the body of a wounded person for his or her safety or 110
172+medical treatment. 111
173+ 4.3. "Minor" has the same meaning as in s. 1.01(13). 112
174+ (f) The Department of Financial Services shall adopt rules 113
175+specifying injuries qualifying as grievous bodily h arm of a 114
176+nature that shocks the conscience for the purposes of this 115
177+subsection. 116
178+ (6) An employing agency of a first responder, including 117
179+volunteer first responders, must provide educational training 118
180+related to mental health awareness, prevention, mitigati on, and 119
181+treatment. As used in this subsection, the term "first 120
182+responder" also includes a part -time law enforcement officer as 121
183+defined in s. 943.10(6) and an auxiliary law enforcement officer 122
184+as defined in s. 943.10(8). 123

310- (6) An employing agency of a first responder, including 201
311-volunteer first responders, must provide at least 1 hour 202
312-annually of educational training related to mental health 203
313-awareness, prevention, mitigation, and treatment. 204
314- (a) The required educational training may be provided in 205
315-person, in video format, or through other electronic means and 206
316-must include evidence-based coping strategies to mitigate 207
317-traumatic stress. The required educational training must also 208
318-include, but is not limited to, peer support programs as the 209
319-term "peer support" is defined in s. 111.09, mental health 210
320-awareness training provided by a licensed mental health 211
321-practitioner who specializes in posttraumatic stress disorder, 212
322-and suicide prevention programs. 213
323- (b) As used in this subsection, the term "first responder" 214
324-includes those persons described in subsection (1) and also 215
325-includes a part-time law enforcement officer as defined in s. 216
326-943.10(6) and an auxiliary law enforcement officer as defined in 217
327-s. 943.10(8). 218
