A bill to be entitled 1 
An act relating to identification of persons with 2 
special needs; amending s. 322.051, F.S.; requiring 3 
the Department of Highway Safety and Motor Vehicles to 4 
include a person's name in specified databases when 5 
the person receives a developmental disability 6 
designation on his or her identification card; 7 
authorizing a person with Alzheimer's disease or a 8 
dementia-related disorder to have a designation placed 9 
on his or her identification card; defining the term 10 
"immediate family member"; requiring the department to 11 
include the person's name in specified databases when 12 
he or she receives such a designation; amending s. 13 
322.14, F.S.; requiring the Department of Highw ay 14 
Safety and Motor Vehicles to include a person's name 15 
in specified databases when he or she receives a 16 
developmental disability designation on his or her 17 
driver license; authorizing a person with Alzheimer's 18 
disease or a dementia -related disorder to have a 19 
designation placed on his or her driver license; 20 
defining the term "immediate family member"; requiring 21 
the department to include the person's name in 22 
specified databases when he or she receives such a 23 
designation; providing an effective date. 24

Be It Enacted by the Legislature of the State of Florida: 26 
 27 
 Section 1.  Paragraph (e) of subsection (8) of section 28 
322.051, Florida Statutes, is amended, and paragraph (f) is 29 
added to that subsection, to read: 30 
 322.051  Identification cards. — 31 
 (8) 32 
 (e)1.  Upon request by a person who has a developmental 33 
disability, or by a parent or guardian of a child or ward who 34 
has a developmental disability, the department shall issue an 35 
identification card exhibiting a capital "D" for the person, 36 
child, or ward if the pe rson or the parent or guardian of the 37 
child or ward submits: 38 
 a.  Payment of an additional $1 fee; and 39 
 b.  Proof acceptable to the department of a diagnosis by a 40 
licensed physician of a developmental disability as defined in 41 
s. 393.063. 42 
 2.  The department shall deposit the additional $1 fee into 43 
the Agency for Persons with Disabilities Operations and 44 
Maintenance Trust Fund under s. 20.1971(2). 45 
 3.  A replacement identification card that includes the 46 
designation may be issued without payment of the fee req uired 47 
under s. 322.21(1)(f). 48 
 4.  The department shall develop rules to facilitate the 49 
issuance, requirements, and oversight of developmental 50

disability identification cards under this section. 51 
 5.  If a person receives the "D" identifier on his or her 52 
identification card, such information must be included through 53 
the Driver and Vehicle Information Database and available 54 
through the Florida Crime Information Center system. 55 
 (f)1.a.  Upon request by a person who has Alzheimer's 56 
disease or a dementia -related disorder, or by a legal guardian 57 
or an immediate family member of a person with Alzheimer's 58 
disease or a dementia -related disorder, the capital letters "AD" 59 
shall be exhibited on the identification card of the person with 60 
Alzheimer's disease or a dementia -related disorder, if the 61 
person, or his or her legal guardian or immediate family member 62 
presents proof that the person has been diagnosed with 63 
Alzheimer's disease or a dementia -related disorder by a licensed 64 
physician, licensed physician assistant, or a l icensed advanced 65 
practice registered nurse. 66 
 b.  As used in this subparagraph, the term "immediate 67 
family member" means a parent, spouse, child, sibling, 68 
grandchild, brother-in-law, sister-in-law, son-in-law, daughter-69 
in-law, mother-in-law, or father-in-law. 70 
 2.  If a person receives the "AD" identifier on his or her 71 
identification card, such information must be included through 72 
the Driver and Vehicle information Database and available 73 
through the Florida Crime Information Center system. 74 
Section 2.  Paragraph (f) of subsection (1) of section 322.14, 75

Florida Statutes, is amended, and paragraph (g) is added to that 76 
subsection, to read: 77 
 322.14  Licenses issued to drivers. — 78 
 (1) 79 
 (f)1.  Upon request by a person who has a developmental 80 
disability, or by a parent or legal guardian of a child or ward 81 
who has a developmental disability, the capital letter "D" shall 82 
be exhibited on the driver license of a person who has a 83 
developmental disability, as defined in s. 393.063, if the 84 
person, or his or her parent or legal guardian, presents 85 
sufficient proof that the person has been diagnosed with a 86 
developmental disability by a physician licensed under chapter 87 
458 or chapter 459 as determined by the department. If a person 88 
receives the "D" identifier on his or her driver license, such 89 
information must be included through the Driver and Vehicle 90 
Information Database and available through the Florida Crime 91 
Information Center system. 92 
 2.  Until a person's driver license is next renewed, the 93 
person, or his or her parent or legal guardian, may have the 94 
capital letter "D" added to or removed from his or her license 95 
upon the surrender of his or her current license and 96 
presentation of sufficient proof that the person has been 97 
diagnosed with a developmental disabili ty by a physician 98 
licensed under chapter 458 or chapter 459 as determined by the 99 
department. If the applicant is not conducting any other 100

transaction affecting the driver license, a replacement license 101 
may be issued with the capital letter "D" added or rem oved 102 
without payment of the fee required in s. 322.21(1)(e). 103
