26-Be It Enacted by the Legislature of the State of Florida: 13

28- Section 1. Paragraph (c) of subsection (3) of section 15
29-39.3065, Florida Statut es, is amended to read: 16
30- 39.3065 Sheriffs of certain counties to provide child 17
31-protective investigative services; procedures; funding. 18

33- (c) Funds for providing child protective investigations 20
34-must be identified in the annual appropriation made to t he 21
35-department, which shall award grants for the full amount 22
36-identified to the respective sheriffs' offices. Notwithstanding 23
37-ss. 216.181(16)(b) and 216.351, the department may advance 24
38-payments to the sheriffs for child protective investigations. A 25

31+Be It Enacted by the Legislature of the State of Florida: 18

33+ Section 1. Subsection (12) is added to section 30.49, 20
34+Florida Statutes, to read: 21
35+ 30.49 Budgets.— 22
36+ (12) Notwithstanding any other law, a sheriff may transfer 23
37+funds between the fund and functional categories and object and 24
38+subobject code levels after his or her budget has been approved 25

51-sheriff may carry forward documented unexpended state funds from 26
52-one fiscal year to the next. However, the cumulative amount of 27
53-state funds carried forward may not exceed 8 percent of the 28
54-sheriff's office total contract amount or grant agreement 29
55-amount. Any unexpended state funds in excess of that amount and 30
56-all unexpended federal funds must be returned to the department. 31
57-The funds carried forward may not be used to create increased 32
58-recurring future obligations or for any type of program or 33
59-service that is not curre ntly authorized by the existing 34
60-contract or grant award agreement with the department. The 35
61-expenditure of funds carried forward must be separately reported 36
62-to the department. A sheriff must return all unexpended funds to 37
63-the department if that sheriff's of fice will no longer be 38
64-providing child protective investigations. Funds for the child 39
65-protective investigations may not be integrated into the 40
66-sheriffs' regular budgets. Budgetary data and other data 41
67-relating to the performance of child protective investig ations 42
68-must be maintained separately from all other records of the 43
69-sheriffs' offices and reported to the department as specified in 44
70-the grant award agreement. 45
71- Section 2. This act shall take effect July 1, 2022. 46

100+ (a) Transfers to correct errors in handling receipts and 63
