An act relating to funding for sheriffs; amending s. 2 
39.3065, F.S.; authorizing sheriffs who provide child 3 
protective investigative services to carry forward a 4 
certain percentage of unexpended state funds each 5 
fiscal year; requiring certain funds to be returned to 6 
the Department of Children and Families; prohibiting 7 
funds carried forward from being used in certain ways; 8 
requiring that certain expenditures be repo rted to the 9 
department; requiring certain funds to be returned to 10 
the department; providing an effective date . 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Paragraph (c) of subsection (3) of section 15 
39.3065, Florida Statut es, is amended to read: 16 
 39.3065  Sheriffs of certain counties to provide child 17 
protective investigative services; procedures; funding. — 18 
 (3) 19 
 (c)  Funds for providing child protective investigations 20 
must be identified in the annual appropriation made to t he 21 
department, which shall award grants for the full amount 22 
identified to the respective sheriffs' offices. Notwithstanding 23 
ss. 216.181(16)(b) and 216.351, the department may advance 24 
payments to the sheriffs for child protective investigations. A 25

sheriff may carry forward documented unexpended state funds from 26 
one fiscal year to the next. However, the cumulative amount of 27 
state funds carried forward may not exceed 8 percent of the 28 
sheriff's office total contract amount or grant agreement 29 
amount. Any unexpended state funds in excess of that amount and 30 
all unexpended federal funds must be returned to the department. 31 
The funds carried forward may not be used to create increased 32 
recurring future obligations or for any type of program or 33 
service that is not curre ntly authorized by the existing 34 
contract or grant award agreement with the department. The 35 
expenditure of funds carried forward must be separately reported 36 
to the department. A sheriff must return all unexpended funds to 37 
the department if that sheriff's of fice will no longer be 38 
providing child protective investigations. Funds for the child 39 
protective investigations may not be integrated into the 40 
sheriffs' regular budgets. Budgetary data and other data 41 
relating to the performance of child protective investig ations 42 
must be maintained separately from all other records of the 43 
sheriffs' offices and reported to the department as specified in 44 
the grant award agreement. 45 
 Section 2.  This act shall take effect July 1, 2022. 46
