Be It Enacted by the Legislature of the State of Florida: 15

Section 1. Short title.—This act may be cited as "The 17
Villages Independent Fire Control and Rescue District Act," 18
hereinafter referred to as the "charter." 19
Section 2. Formation; boundaries. —For the purpose of 20
providing fire control; f ire prevention; and emergency medical, 21
rescue response, and public safety services pursuant to chapter 22
191, Florida Statutes, an independent special district is hereby 23
created, incorporated, and established pursuant to chapters 189 24
and 191, Florida Statute s, to be known as The Villages 25

Section 3. Intent.—The purposes of this act are to 371

hampering the efficiency and effectiveness of current authorized 376
and implemented methods and procedures of raising re venues. 377
(3) Improved communication and coordination between the 378
district and other local governments with respect to short -range 379
and long-range planning to meet the demands for service delivery 380
while maintaining fiscal responsibility. 381
(4) Uniform procedures for electing members of the board 382
of commissioners of the district to ensure greater 383
accountability to the public. 384
Section 4. District board of commissioners; membership, 385
officers, and meetings. —The business affairs of the distr ict 386
shall be conducted and administered, pursuant to chapter 191, 387
Florida Statutes, by the board of commissioners of The Villages 388
Independent Fire Control and Rescue District, which is 389
established as a board of five commissioners, elected, 390
organized, and operating pursuant to chapter 191, Florida 391
Statutes. 392
(1) Beginning on the effective date of this act, the 393
district shall be governed by a governing board consisting of 394
five members initially appointed by the Governor and thereafter 395
elected. After soliciti ng recommendations from the public, the 396
Governor may appoint members to the district from the 397
candidates. 398
(2) For the inaugural appointment of members, two members 399
shall be appointed to serve an initial term of 2 years each and 400

3 members shall be appoint ed to serve an initial term of 4 years 401
each. Thereafter, each member shall be elected for a 4 -year 402
term. 403
(3) The term of office for an appointed member shall begin 404
immediately after official appointment by the Governor and shall 405
expire upon the assumptio n of office by his or her successor. 406
Section 5. Powers and duties.—The district shall have, and 407
the board may exercise, all the powers and duties set forth in 408
chapters 189 and 191, Florida Statutes, and this act, as they 409
may be amended from time to tim e, which shall include fire 410
control, fire prevention, and emergency medical, rescue 411
response, and public safety services. Before exercising ad 412
valorem taxing authority, a majority of district electors voting 413
in a referendum conducted by the Supervisor of E lections of 414
Sumter County must approve the exercise of said authority. 415
Section 6. Boundaries.—The boundaries of the district may 416
be modified, extended, or enlarged upon approval or ratification 417
by the Legislature. 418
Section 7. Amendment of charter. —The charter may be 419
amended only by special act of the Legislature. 420
Section 8. Severability.—If any provision of this act or 421
its application to any person or circumstance is held to be 422
invalid, the invalidity shall not affect other provisions or 423
applications of this act which can be given effect without the 424
invalid provision or application, and to this end the provisions 425

of this act are severable. 426
Section 9. Referendum election. —On or before December 31, 427
2023, the Supervisor of Elections of Sumter Cou nty shall conduct 428
a referendum of the qualified electors of the district on the 429
question of whether the district shall be created by special act 430
of the Legislature pursuant to chapter 191, Florida Statutes. 431
The referendum question shall be in substantially the following 432

Funding The Villages Independent Fire Control and 435
Rescue District Services, Administration, and Capital 436
with a mix of Ad Valorem and Non -Ad Valorem Property 437
Assessments. 438

Shall the district cap any ad valorem taxes at 1 mil, 440
and levy annual non-ad valorem assessments beginning 441
with the 2023-2024 fiscal year to fund fire 442
protection, rescue, emergency medical services, 443
administration, governance, and associated capital not 444
exceeding $124 per parcel plus $0.75 per $1,000 of 445
value of improvements thereon, together with 446
identified administrative costs, collection costs, and 447
statutory discounts, with increases limited by growth 448
in Florida personal income over the previous 5 years? 449

Section 10. This act shall take effect only upon its 453
approval by a majority vote of those qualified electors residing 454
within the district voting in a referendum to be held no later 455
than December 31, 2023 , except that this section and section 9 456
shall take effect upon becoming a law. 457
