5151 253.0346 Lease of sovereignty submerged lands for marinas, 26
5252 boatyards, mooring fields, and marine retailers. — 27
5353 (4) Notwithstanding any other law, all of the following 28
5454 conditions apply for approved and permitted moorings or mooring 29
5555 fields in Monroe County: 30
5656 (a) The general tenancy on a mooring may exceed 12 months , 31
5757 if requested, but may not exceed 10 years. 32
5858 (b) A sovereign submerged land or other proprietary lease 33
5959 may not prohibit a vessel from an approved and permitted mooring 34
6060 or mooring field or limit the tenancy of a vessel because an 35
6161 individual has establishe d it as his or her domicile in 36
6262 accordance with s. 222.17 or because the vessel is an 37
6363 individual's primary residence. 38
6464 Section 2. Subsection (3) of section 327.4108, Florida 39
6565 Statutes, is amended to read: 40

6868 (3)(a) Monroe County is designated as an anchoring 43
6969 limitation area within which no less than once every a vessel on 44
7070 waters of the state may only be anchored in the same location 45

9090 vessel's starting location. A vessel may not be re -anchored 53
9191 within one-half linear nautical mile from the vessel's starting 54
9292 location for at least 90 days; or 55
9393 2. In a different designated anchor ing area. A vessel may 56
9494 not be re-anchored in its originating designated anchoring area 57
9595 for at least 90 days after anchoring within a new designated 58
9696 anchoring area. The commission shall adopt rules to implement 59
9797 this subsection. 60
9898 (b) The commission, in cons ultation with Monroe County and 61
9999 the Florida Keys National Marine Sanctuary, shall establish by 62
100100 rule designated anchoring areas throughout the county. The 63
101101 designated anchoring areas must: 64
102102 1. Specify a maximum vessel draft for each area; 65
103103 2. Be created only in locations where the water depth is 66
104104 sufficient to allow vessels whose drafts are less than the 67
105105 area's specified maximum vessel draft to navigate into and out 68
106106 of the areas without grounding or stranding; 69
107107 3. Not be located over coral reefs or other sensitive fish 70
108108 or wildlife habitat, to the maximum extent practicable, as 71
109109 determined by the commission; 72
110110 4. Not be located in an area subject to ongoing hazardous 73
111111 water currents or tides or containing navigational hazards; and 74
112112 5. Not be located within navigational channels, setbacks 75

127127 prohibited pursuant to s. 327.4109, or any other lawfully 78
128128 established areas that prohibit anch oring. 79
129129 (c) Paragraph (a) does The anchoring limitations in this 80
130130 subsection do not apply to vessels moored to approved and 81
131131 permitted moorings or mooring fields. 82
132132 (d)(c) A vessel upon the waters of this state and within 83
133-Monroe County, for which the owner or occupant has established 84

143143 priority for the investigation and removal of derelict vessels. 94
144144 (e) All of the following vessels within Monroe County on 95
145145 waters of this state which are equipped with a marine sanitation 96
146146 device other than a marine composting toilet that processes and 97
147147 manages human waste using technologies that comply with United 98
148148 States Coast Guard requirements must maintain a record of the 99
149149 date of each pumpout of the marine sanitation device and the 100

162162 location of the pumpout station or waste reception facility for 101
163-1 year after the date of the pumpout, and the record must 102
164-indicate that the vessel was pumped out within the last 30 days: 103

166- a. Has enclosed living spaces or rooms; and 105
167- b. Is used by a person as a dwelling or living space 106
168-overnight at any time, notwithstanding whether or not the vessel 107

171- (f) This subsection does not pr ohibit anchoring for less 110

173- Section 3. This act shall take effect July 1, 2022. 112
