An act relating to treatment of defendants adjudicated 2
incompetent to stand trial; amending s. 916.106, F.S.; 3
revising the definition of the term "forensic 4
facility"; providing an effective date. 5

Be It Enacted by the Legislature of the State of Florida: 7

Section 1. Subsection (10) of section 916.106, Florida 9
Statutes, is amended to read: 10
916.106 Definitions. —For the purposes of this chapter, the 11
term: 12
(10) "Forensic facility" means a separate and secure 13
facility established within the department or agency , or 14
contracted using department funding, to serve forensic clients. 15
A separate and secure facility means a security -grade building 16
for the purpose of separately hous ing persons who have mental 17
illness from persons who have intellectual disabilities or 18
autism and separately housing persons who have been 19
involuntarily committed pursuant to this chapter from 20
nonforensic residents. The term includes a facility serving 21
forensic clients committed to the department which is colocated 22
in a county jail and operated by a community mental health 23
provider through a contract. 24
Section 2. This act shall take effect July 1, 2022. 25
