Paragraphs (c) and (d) of subsection (18) of 19 section 1002.20, Florida Statutes, are amended to read: 20 1002.20 K-12 student and parent rights.—Parents of public 21 school students must receive accurate and timely information 22 regarding their child's academic progress and must be informed 23 of ways they can help their child to succeed in school. K -12 24 students and their parents are afforded numer ous statutory 25 CS/HB 259 2023 CODING: Words stricken are deletions; words underlined are additions. hb0259-01-c1 Page 2 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S rights including, but not limited to, the following: 26 (18) EXTRACURRICULAR ACTIVITIES. —In accordance with the 27 provisions of s. 1006.15: 28 (c) Charter school students. —Charter school students who 29 meet specified academic and conduct requiremen ts are eligible to 30 participate in extracurricular activities at the public school 31 to which the student would be assigned or could choose to attend 32 according to district school board policies, or may develop an 33 agreement to participate at a private school, unless such 34 activity is provided by the student's charter school. 35 (d) Florida Virtual School full -time students.—Florida 36 Virtual School full-time students who meet specified academic 37 and conduct requirements are eligible to participate in 38 extracurricular activities at the public school to which the 39 student would be assigned or could choose to attend according to 40 district school board policies , or may develop an agreement to 41 participate at a private school . 42 Section 2. Subsection (11) of section 1002.33 , Florida 43 Statutes, is amended to read: 44 1002.33 Charter schools. — 45 (11) PARTICIPATION IN INTERSCHOLASTIC EXTRACURRICULAR 46 ACTIVITIES.—A charter school student is eligible to participate 47 in an interscholastic extracurricular activity at the public 48 school to which the student would be otherwise assigned to 49 attend, or may develop an agreement to participate at a private 50 CS/HB 259 2023 CODING: Words stricken are deletions; words underlined are additions. hb0259-01-c1 Page 3 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S school, pursuant to s. 1006.15(3)(d). 51 Section 3. Paragraphs (d) and (e) of subsection (3) of 52 section 1006.15, Florida Statutes, are ame nded to read: 53 1006.15 Student standards for participation in 54 interscholastic and intrascholastic extracurricular student 55 activities; regulation. — 56 (3) 57 (d) An individual charter school student pursuant to s. 58 1002.33 is eligible to participate at the pub lic school to which 59 the student would be assigned according to district school board 60 attendance area policies or which the student could attend , or 61 may develop an agreement to participate at a private school, in 62 any interscholastic extracurricular activity of that school, 63 unless such activity is provided by the student's charter 64 school, if the following conditions are met: 65 1. The charter school student must meet the requirements 66 of the charter school education program as determined by the 67 charter school governing board. 68 2. During the period of participation at a school, the 69 charter school student must demonstrate educational progress as 70 required in paragraph (b). 71 3. The charter school student must meet the same residency 72 requirements as other students in the school at which he or she 73 participates. 74 4. The charter school student must re gister with the 78 school his or her intent to participate in interscholastic 79 extracurricular activities as a representative of the school 80 before participation. A charter school student must be able to 81 participate in curricular activities if that is a require ment 82 for an extracurricular activity. 83 6. A student who transfers from a charter school program 84 to a traditional public school before or during the first 85 grading period of the school year is academically eligible to 86 participate in interscholastic extracur ricular activities during 87 the first grading period if the student has a successful 88 evaluation from the previous school year, pursuant to 89 subparagraph 2. 90 7. Any public school or private school student who has 91 been unable to maintain academic eligibility f or participation 92 in interscholastic extracurricular activities is ineligible to 93 participate in such activities as a charter school student until 94 the student has successfully completed one grading period in a 95 charter school pursuant to subparagraph 2. to be come eligible to 96 participate as a charter school student. 97 (e) A student of the Florida Virtual School full -time 98 program may participate in any interscholastic extracurricular 99 activity at the public school to which the student would be 100 CS/HB 259 2023 CODING: Words stricken are deletions; words underlined are additions. hb0259-01-c1 Page 5 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S assigned according to district school board attendance area 101 policies or which the student could choose to attend pursuant to 102 s. 1002.31, or may develop an agreement to participate at a 103 private school, if the student: 104 1. During the period of participation in the 105 interscholastic extracurricular activity, meets the requirements 106 in paragraph (a). 107 2. Meets any additional requirements as determined by the 108 board of trustees of the Florida Virtual School. 109 3. Meets the same residency requirements as other students 110 in the school at which he or she participates. 111 4. Meets the same standards of acceptance, behavior, and 112 performance that are required of other students in 113 extracurricular activities. 114 5. Registers his or her intent to participate in 115 interscholastic extracurricular ac tivities with the school 116 before participation. A Florida Virtual school student must be 117 able to participate in curricular activities if that is a 118 requirement for an extracurricular activity. 119 Section 4. This act shall take effect July 1, 2023. 120
