23-Be It Enacted by the Legislature of the State of Florida: 10

25- Section 1. Paragraph (c) of subsection (1) of section 12
26-320.08, Florida Statutes, is amended to read: 13
27- 320.08 License taxes. —Except as otherwise provided herein, 14
28-there are hereby levied and imposed annual license taxes for the 15
29-operation of motor vehicles, mopeds, tri -vehicles as defined in 16
30-s. 316.003, and mobile homes as defined in s. 320.01, which 17
31-shall be paid to and collected by the department or its agent 18
32-upon the registration or renewal of registration of the 19
33-following: 20
34- (1) MOTORCYCLES AND MOPEDS. — 21
35- (c) Upon registration of a motorcycle, motor -driven cycle, 22
36-or moped, in addition to the license taxes specified in this 23
37-subsection, a nonrefundable motorcycle safety education fee in 24
38-the amount of $2.50 shall be paid. The proceeds of such 25
16+education; amending s. 320.08, F.S.; requiring 3
17+proceeds of the motorcycle safety education fee 4
18+collected by the Department of Highway Safety and 5
19+Motor Vehicles to be used to fund motorcycle safety 6
20+and education programs administered by a not -for-7
21+profit corporation; providing program administrator 8
22+requirements; requiring the department to enter into a 9
23+contract with the program administrator; providing 10
24+program requirements; requiring the program 11
25+administrator to submit an annual report to the 12
26+Legislature; providing report requirements; requiring 13
27+the department to select a program administrator and 14
28+enter into a contract by a specified date; requiring 15
29+quarterly transmission of proceeds to the program 16
30+administrator beginning on a specified date; providing 17
31+an effective date. 18

33+Be It Enacted by the Legislature of the State of Florida: 20

51-additional fee shall be deposited in the Highway Safety 26
52-Operating Trust Fund to fund a motorcycle driver improvement 27
53-program implemented pursuant to s. 322.025 or, the Florida 28
54-Motorcycle Safety Education Program established in s. 322.0255 , 29
55-or the general operations of the department . The department 30
56-shall submit an annual report to the President of the Senate and 31
57-the Speaker of the House of Representatives outlining the 32
58-revenues collected by the fee, funds and methods used to 33
59-administer motorcycle safety and awareness programs, and an 34
60-estimate of the number of persons exposed to such efforts. 35
61- Section 2. This act shall take effect October 1, 2023. 36

66+ 1. All proceeds of the motorcycle safety education fee 41
67+shall be used to fund motorcycle safety and education programs 42
68+administered by a Florida not -for-profit corporation. The 43
69+program administrator must: 44
70+ a. Be a charity registered with the Departmen t of 45
71+Agriculture and Consumer Services. 46
72+ b. Have a history of actively advocating for motorcycle 47
73+safety and education in this state for at least 30 years. 48
74+ c. Be a motorcycle grassroots organization that has 49
75+actively worked with the motorcycle community in this state for 50

88+at least 30 years. 51
89+ d. Be focused primarily on promoting motorcycle safety and 52
90+education throughout this state. 53
91+ e. Have at least 3,000 active members drawn from the 54
92+motorcycle community throughout this state. 55
93+ 2. The department shall enter into a 5-year contract with 56
94+the program administrator to use the proceeds of the safety 57
95+education fee to fund motorcycle safety and education programs. 58
96+The programs must promote motorcycle safety and education for 59
97+the purpose of reducing motorcycle i njuries and deaths in this 60
98+state. The programs may include pamphlets, advertisements, 61
99+public service announcements, digital media, social media, a 62
100+website, participation at grassroots motorcycle events, 63
101+advocacy, and reasonable administrative expenses. 64
102+ 3. The program administrator shall submit an annual report 65
103+to the President of the Senate and the Speaker of the House of 66
104+Representatives outlining the types of events the program 67
105+administrator attended, if any, the methods selected to 68
106+distribute safety awa reness and education materials or to expose 69
107+the public to the programs, and the estimated number of persons 70
108+who were exposed to the program administrator's educational 71
109+efforts. 72
110+ Section 2. By October 1, 2023, the Department of Highway 73
111+Safety and Motor Vehicles shall select a qualified program 74
112+administrator and enter into the contract as specified in this 75

125+act. The department shall transmit the proceeds of the safety 76
126+education fee quarterly to the administrator, with the first 77
127+payment being payable October 1, 2023. 78
128+ Section 3. This act shall take effect July 1, 2023. 79
