17	17		certain local governmental entities, subject to 4
18	18		specified exceptions, from enacting or enforcing a 5
19	19		resolution, an ordinance, a rule, a code, or a policy 6
20	20		or from taking any action that restricts or prohibits 7
21	21		or has the effect of restricting or prohibiting the 8
22	22		use of appliances; revising an exception to 9
23	23		preemption; defining the term "appliance"; providing 10

26	26		Be It Enacted by the Legislature of the State of Florida: 13

28	28		Section 1. Subsections (2) through (4) of section 366.032, 15
29	29		Florida Statutes, are renumbered as (3) through (5), 16
30	30		respectively, subsection (1) and present subsection (2) are 17
31	31		amended, and a new subsection (2) is added to that section, to 18
32	32		read: 19
33	33		366.032 Preemption over utility service restrictions. — 20
34	34		(1) A municipality, county, special district, or other 21
35	35		political subdivision of the state may not enact or enforce a 22
36	36		resolution, ordinance, rule, code, or policy or take any action 23
37	37		that restricts or prohibits or has the effect of restricting or 24
38	38		prohibiting the types or fuel sources of energy production which 25

51	51		may be used, delivered, converted, or supplied by the following 26
52	52		entities to serve customers that such entities are authorized to 27
53	53		serve: 28
54	54		(a) A public utility or an electric utility as defined in 29
55	55		this chapter; 30
56	56		(b) An entity formed under s. 163.01 that generates, 31
57	57		sells, or transmits electrical energy; 32
58	58		(c) A natural gas utility as defined in s. 366.04(3)(c); 33
59	59		(d) A natural gas transmission company as defined in s. 34
60	60		368.103; or 35
61	61		(e) A Category I liquefied petroleum gas dealer or 36
62	62		Category II liquefied petroleum gas dispenser or Category III 37
63	63		liquefied petroleum gas cylinder exchange operator as defined in 38
64	64		s. 527.01. 39
65	65		(2) Except to the extent necessary to enforce the Florida 40
66	66		Building Code adopted pursuant to s. 553.73 or the Florida Fire 41
67	67		Prevention Code adopted pursuant to s. 633.202, a municipality, 42
68	68		county, special district, or other political subdivision of the 43
69	69		state may not enact or enforce a resolution, an ordinance, a 44
70	70		rule, a code, or a policy or take any action that restricts or 45
71	71		prohibits or has the effect of restricting or prohibiting the 46
72	72		use of an appliance, including a stove or grill, which uses the 47
73	73		types or fuel sources of energy production which may be used, 48
74	74		delivered, converted, or supplied by the entities listed in 49
75	75		subsection (1). As used in this subsection, the ter m "appliance" 50

88	88		means a device or apparatus manufactured and designed to use 51
89	89		energy and for which the Florida Building Code or the Florida 52
90	90		Fire Prevention Code provides specific requirements. 53
91	91		(3)(2) Notwithstanding the restrictions of this section, 54
92	92		this section does not prevent the board of a municipality or 55
93	93		governmental entity which owns or operates and directly controls 56
94	94		an electric or natural gas utility , from passing rules, 57
95	95		regulations, or policies governing the utility. 58
96	96		Section 2. This act shall tak e effect July 1, 2023. 59
