24	24	as a part of a local housing assistance plan; 11
25	25	providing for expiration and retroactive 12
26	26	applicability; providing an effective date. 13

28	28	Be It Enacted by the Legislature of the State of Florida: 15

30	30	Section 1. Subsection (5) of section 125.01055, Florida 17
31	31	Statutes, are amended to read: 18
32	32	125.01055 Affordable housing. — 19
33	33	(5) Subsection (6) (2) does not apply in an area of 20
34	34	critical state concern, as designated in s. 380.0552. 21
35	35	Section 2. Subsection (5) of section 166.04151, Florida 22
36	36	Statutes, is amended to read: 23

52	52	28-36, Florida Administrative Code. 27
53	53	Section 3. Paragraph (g) of subsection (5) of section 28
54	54	420.9075, Florida Statutes, is amended to read: 29
55	55	420.9075 Local housing assistance plans; partnerships. — 30
56	56	(5) The following criteria apply to awards made to 31
57	57	eligible sponsors or eligible persons for the purpose of 32
58	58	providing eligible housing: 33
59	59	(g)1. All units constructed, rehabilitated, or otherwise 34
60	60	assisted with the funds provided from the local housing 35
61	61	assistance trust fund must be occupied by very -low-income 36
62	62	persons, low-income persons, and moderat e-income persons except 37
63	63	as otherwise provided in this section. 38
64	64	2.a. At least 30 percent of the funds deposited into the 39
65	65	local housing assistance trust fund must be reserved for awards 40
66	66	to very-low-income persons or eligible sponsors who will serve 41
67	67	very-low-income persons, and at least an additional 30 percent 42
68	68	of the funds deposited into the local housing assistance trust 43
69	69	fund must be reserved for awards to low -income persons or 44
70	70	eligible sponsors who will serve low -income persons. 45
71	71	b. This subparagraph doe s not apply to a county or an 46
72	72	eligible municipality whose land has been designated within the 47
73	73	previous 5 years as an area of critical state concern by the 48
74	74	Legislature for which the Legislature has declared its intent to 49
75	75	provide affordable housing. This sub -subparagraph expires on 50
