A bill to be entitled 1 
An act relating to affordable housing in areas of 2 
critical state concern; amending ss. 125.01055 and 3 
166.04151, F.S.; excluding land designated as an area 4 
of critical state concern from county and municipality 5 
affordable housing provisions; amending s. 420.9075, 6 
F.S.; excluding land designated as an area of critical 7 
state concern within a specified time period from 8 
award requirements made to specified sponso rs or 9 
persons for the purpose of providing eligible housing 10 
as a part of a local housing assistance plan; 11 
providing for expiration and retroactive 12 
applicability; providing an effective date. 13

Be It Enacted by the Legislature of the State of Florida: 15 
 16 
 Section 1.  Subsection (5) of section 125.01055, Florida 17 
Statutes, are amended to read: 18 
 125.01055  Affordable housing. — 19 
 (5)  Subsection (6) (2) does not apply in an area of 20 
critical state concern, as designated in s. 380.0552. 21 
 Section 2.  Subsection (5) of section 166.04151, Florida 22 
Statutes, is amended to read: 23 
 166.04151  Affordable housing. — 24 
 (5)  Subsection (6) (2) does not apply in an area of 25

critical state concern, as designated by s. 380.0552 or chapter 26 
28-36, Florida Administrative Code. 27 
 Section 3.  Paragraph (g) of subsection (5) of section 28 
420.9075, Florida Statutes, is amended to read: 29 
 420.9075  Local housing assistance plans; partnerships. — 30 
 (5)  The following criteria apply to awards made to 31 
eligible sponsors or eligible persons for the purpose of 32 
providing eligible housing: 33 
 (g)1.  All units constructed, rehabilitated, or otherwise 34 
assisted with the funds provided from the local housing 35 
assistance trust fund must be occupied by very -low-income 36 
persons, low-income persons, and moderat e-income persons except 37 
as otherwise provided in this section. 38 
 2.a. At least 30 percent of the funds deposited into the 39 
local housing assistance trust fund must be reserved for awards 40 
to very-low-income persons or eligible sponsors who will serve 41 
very-low-income persons, and at least an additional 30 percent 42 
of the funds deposited into the local housing assistance trust 43 
fund must be reserved for awards to low -income persons or 44 
eligible sponsors who will serve low -income persons. 45 
 b.  This subparagraph doe s not apply to a county or an 46 
eligible municipality whose land has been designated within the 47 
previous 5 years as an area of critical state concern by the 48 
Legislature for which the Legislature has declared its intent to 49 
provide affordable housing. This sub -subparagraph expires on 50

July 1, 2028, and applies retroactively. 51 
 Section 4.  This act shall take effect July 1, 2023. 52
