A bill to be entitled 1 
An act relating to a review under the Open Government 2 
Sunset Review Act; amending s. 119.071, F.S., which 3 
provides an exemption from public record requirements 4 
for certain information relating to the Nationwide 5 
Public Safety Broadband Network held by an agency; 6 
removing the scheduled repeal of the exemption; 7 
providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10 
 11 
 Section 1. Paragraph (d) of subsection (3) of section 12 
119.071, Florida Statutes, is amended to read: 13 
 119.071  General exemptions from inspection or copying of 14 
public records.— 15 
 (3)  SECURITY AND FIRESAFETY. — 16 
 (d)1. Information relating to the Nationwide Public Sa fety 17 
Broadband Network established pursuant to 47 U.S.C. ss. 1401 et 18 
seq., held by an agency is confidential and exempt from s. 19 
119.07(1) and s. 24(a), Art. I of the State Constitution if 20 
release of such information would reveal: 21 
 1.a. The design, development, construction, deployment, 22 
and operation of network facilities; 23 
 2.b. Network coverage, including geographical maps 24 
indicating actual or proposed locations of network 25

infrastructure or facilities; 26 
 3.c. The features, functions, and capabilities of n etwork 27 
infrastructure and facilities; 28 
 4.d. The features, functions, and capabilities of network 29 
services provided to first responders, as defined in s. 30 
112.1815, and other network users; 31 
 5.e. The design, features, functions, and capabilities of 32 
network devices provided to first responders and other network 33 
users; or 34 
 6.f. Security, including cybersecurity, of the design, 35 
construction, and operation of the network and associated 36 
services and products. 37 
 2.  This paragraph is subject to the Open Governmen t Sunset 38 
Review Act in accordance with s. 119.15 and shall stand repealed 39 
on October 2, 2023, unless reviewed and saved from repeal 40 
through reenactment by the Legislature. 41 
 Section 2.  This act shall take effect October 1, 2023. 42
