HB 7029 2023 CODING: Words stricken are deletions; words underlined are additions. hb7029-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to a review under the Open Government 2 Sunset Review Act; amending s. 943.687, F.S., which 3 provides an exemption from public meeting requirements 4 for certain meetings of the Marjory Stoneman Douglas 5 High School Public Safety Commission; removing the 6 scheduled repeal of the exemption; amending s. 7 1006.12, F.S., which provides an exemption from public 8 record requirements for any information held by 9 certain entities that would identify individuals who 10 have been appointed as safe -school officers; removing 11 the scheduled repeal of the exemption; providing an 12 effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Subsection (8) of section 943.687, Florida 17 Statutes, is amended to read: 18 943.687 Marjory Stoneman Douglas High School Public Safety 19 Commission.— 20 (8) Any portion of a meeting of the Marjory Stoneman 21 Douglas High School Public Safety Commission at which exem pt or 22 confidential and exempt information is discussed is exempt from 23 s. 286.011 and s. 24(b), Art. I of the State Constitution. Subsection (8) of section 1006.12, Florida 29 Statutes, is amended to read: 30 1006.12 Safe-school officers at each public school. —For 31 the protection and safety of school personnel, property, 32 students, and visitors, each district school board and school 33 district superintendent shall partner with law enforcement 34 agencies or security agencies to establish or assign one or more 35 safe-school officers at each s chool facility within the 36 district, including charter schools. A district school board 37 must collaborate with charter school governing boards to 38 facilitate charter school access to all safe -school officer 39 options available under this section. The school dis trict may 40 implement any combination of the options in subsections (1) -(4) 41 to best meet the needs of the school district and charter 42 schools. 43 (8) EXEMPTION.—Any information that would identify whether 44 a particular individual has been appointed as a safe -school 45 officer pursuant to this section held by a law enforcement 46 agency, school district, or charter school is exempt from s. 47 119.07(1) and s. 24(a), Art. I of the State Constitution. This 48 subsection is subject to the Open Government Sunset Review Act 49 in accordance with s. 119.15 and shall stand repealed on October 50 HB 7029 2023 CODING: Words stricken are deletions; words underlined are additions. hb7029-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 2, 2023, unless reviewed and saved from repeal through 51 reenactment by the Legislature. 52 53 If a district school board, through its adopted policies, 54 procedures, or actions, denies a charter school a ccess to any 55 safe-school officer options pursuant to this section, the school 56 district must assign a school resource officer or school safety 57 officer to the charter school. Under such circumstances, the 58 charter school's share of the costs of the school res ource 59 officer or school safety officer may not exceed the safe school 60 allocation funds provided to the charter school pursuant to s. 61 1011.62(12) and shall be retained by the school district. 62 Section 3. This act shall take effect October 1, 2023. 63
